A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS, FLORIDA, AMENDING THE TIME TO ADVERTISE THE
SOLICITATION OF COMPETITIVE BIDS OR PROPOSALS
RELATING TO THE RENOVATION OF THE POLICE
HEADQUARTERS BUILDING FROM THIRTY (30) DAYS TO
TWENTY-ONE (21) DAYS IN ACCORDANCE WITH SECTION
255.0525(2), FLORIDA STATUTES; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE
DATE
Summary
Chapter 255 Florida Statues provides an "emergency provision" under which
local governments may waive the statutory 30 day advertising period for
construction contracts. Staff is requesting that City Council make an emergency
declaration for the completion of the Police Department renovation; thereby
allowing staff to advertise for only a 21 day period for construction bids for the
renovation of the police headquarters bui~ding. Bids will be brought back to City
Council at your October 10t" meeting for final award.
Even with this waiver, it will only provide 6 weeks to complete the work prior to
the start-up of the department. In order to encourage the bidders to complete
certain critical components needed at start-up, staff would like to offer a$25,000
bonus if the contractor can provide "beneficial use" of three critical areas by

the renovations will costs befinreen $500,000 and $600,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS, FLORIDA, AMENDING THE TIME TO ADVERTISE THE
SOLICITATION OF COMPETITIVE BIDS OR PROPOSALS RELATING
TO THE RENOVATION OF THE POLICE HEADQUARTERS BUILDING
FROM THIRTY (30) DAYS TO TWENTY-ONE (21) DAYS IN
ACCORDANCE WITH SECTION 255.0525(2), FLORIDA STATUTES;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING AN EFFECTIVE DATE.
1 WHEREAS, the City of Miami Gardens plans to implement its own Police
2 Department commencing December 1, 2008, and
3 WHEREAS, the City recently purchased a building that will serve as Police
4 Headquarters, and it is necessary, that the building be renovated so that it is operational
5 and functional as of December 1, 2008, and
6 WHEREAS, the Architect hired by the City, is in the process of finalizing plans for
7 the renovation of the Police Headquarters building, but that process has taken longer
8 than expected, and
9 WHEREAS, in accordance with Section 255.0525, a construction project that is
10 projected to cost more than $500,000.00 must be publicly advertised for thirty (30) days
11 prior to bid opening, and
12 WHEREAS, in light of the time constraints relating to the planned opening for the
13 Police Department, the 30 day timeframe is likely to delay the proposed renovations
14 which would in turn delay having the Police Headquarters building ready for the
15 December 1, 2008, timeframe, and
16 WHEREAS, the City Manager is recommending, that in accordance with Section
17 255.0525(2) of the Florida Statutes, that the City Council declare an emergency and

18 amend the timeframe for advertising the bid prior to bid opening from 30 days to 21
19 days,
20 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
21 OF MIAMI GARDENS, FLORIDA, AS FOLLOWS:
22 Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas
23 paragraphs are hereby ratified and confirmed as being true, and the same are hereby
24 made a specific part of this Resolution.
25 Section 2. DETERMINATION OF AN EMERGENCY: The City Council of the
26 City of Miami Gardens hereby determines, that an emergency exists with respect to the
27 renovations of the Police Headquarters building. Instead of the 30-day advertising
28 period prior to bid opening for proposals submitted for the Police Headquarters
29 renovation, the City Council hereby authorizes the City Manager to advertise the bids
30 for the Police Headquarters building's renovation for a period of 21 days in accordance
31 with Section 255.0525(2), Florida Statutes.
32 Section 3. EFFECTIVE DATE: This Resolution shall take effect immediately
33 upon its final passage.
