Clerk and pay an annual fee of $250.00. This applies to all persons who are retained (whether paid or not) to represent a business entity or organization to influence “City” action.
“City” action is broadly described to include the ranking and selection of professional consultants, and virtually all legislative, quasi-judicial and administrative action. All not-for-profit

for public hearings to be heard during the early portion of future City Councils’ Meetings. Proposed Action: That City Council adopt this ordinance on first reading, with second reading

be maintained in City Council meetings to allow for a dissemination of ideas from the public, as well as thoughtful deliberations by the Council. When audience members become disorderly
and disrespectful to each other, members of the City Council or City staff, it can interrupt these ideas and deliberations. Therefore, Vice Mayor Aaron Campbell recommends that the Chief
of Police of the City of Miami Gardens, or his or her designee, serve as Sergeant-At-Arms during Council meetings. Proposed Action: Vice Mayor Aaron Campbell recommends that the Council

4 Section 2. AMENDMENT: Article II, Section 2-60 of the Miami 5 Gardens Code of Ordinances is hereby amended to add the following: 6 : 7 (g) Sergeant-At-Arms. 8 9 The Chief of Police
of the City of Miami Gardens or his/her 10 designee shall serve as Sergeant-At-Arms at all meetings of the 11 City Council. Such person(s) shall carry out all lawful orders and 12 instructions
given by the presiding officer for maintaining order and 13 decorum at the meetings. 14 15 Section 3. CONFLICT: All ordinances or Code provisions in conflict 16 herewith are hereby repealed.
17 Section 4. SEVERABILITY: If any section, subsection, sentence, 18 clause, phrase or portion of this Ordinance is for any reason held invalid or 19 unconstitutional by any court of
competent jurisdiction, such portion shall be 20 deemed a separate, distinct and and independent provision and such holding shall 21 not affect the validity of the remaining portions

Summary On September 21, 2009, the City Council under Resolution No: 2009-173-1118, authorized the City Manager to negotiate and execute a contract with SA Consultants, LLC, for the
design and construction of two sets of bleachers for the sports field at the Betty T. Ferguson Recreation Complex located at 3000 NW 199th Street. The project scope included one set
of bleachers east of the sports field and another set of bleachers to the west with a press box and vertical lift. At this time the construction has been declared Substantially Completed
and will soon achieve Final Completion. SA Consultants, LLC, has submitted a request for additional time for the design and construction of the bleachers. Staff has reviewed the request
for the time extension and is recommending that an additional 216 days be granted to SA Consultants, LLC. If approved by Council, the Change Order will extend the construction final
completion date from March 9, 2010 to October 11, 2010. The requested time extensions occurred due to project conditions and events beyond the direct control of the Design-Build contractor.

days with final construction completion achieved 30 calendar days later for a total contract time of 135 calendar days. During the course of the project design and construction three
(3) specific delays occurred affecting the original project schedule hence impacting the original final construction completion date of March 9, 2010. The construction schedule was adversely
affected due to the following delays: 1. Miami-Dade Fire Department requirement for Emergency Lighting 113 Days 2. Miami-Dade Fire Department Permit processing delay 54 Days 3. Conflict
with existing site elevations & concrete slab re-design 49 Days Total Calendar Days Recommended: 216 Days The total time extension recommended by the City staff is 216 calendar days,
for a total of 351 days to design and construct the Bleachers, Press Box and Vertical Lift. If this recommendation is accepted, the new final construction completion date will be October
11, 2010. The contract for the project does not allow for additional compensation to the contractor for time extensions, hence the recommendation does not increase the contract amount.
Proposed Action: It is recommended that City Council approve the attached resolution allowing the City Manager to authorize Change Order #1 which will extend the project final construction

reflects the pricing utilizing the Clay County bid 08/09-3. Clay County competitively bid for “Various Equipment and Amenities for Parks and Playgrounds” Musco Sports Lighting, LLC was
awarded sports lighting. The new field lighting is reflective of the standardized design for all future park designs, exhibiting L.E.E.D. (Leadership in Energy Elements and Design),
green principals and focused projection allowing minimal reflection into neighboring residences. Musco Sports Lighting has recently been installed with success at the Betty T. Ferguson
Community Center, Miami Carol City Park, North Dade Optimist Park fields and on the basketball courts and the new tennis courts at Rolling Oaks Park. The City will utilize Community
Development Block Grant (CDBG) funds for this project. Community Development Staff has identified $150,000 150,000 of CDBG funds from Program Year 3 (2008-09) that is available for Park
Capital Improvements. Brentwood Park is in a census tract that has more than 51% of its households that are low-tomoderate income, and is therefore an eligible project under the CDBG
program. This project will work in conjunction with the City’s Program Year 5 (2010-11) Annual Action Plan, which includes funding for the installation of the lighting to allow for improved
facilities and expansion of usage. Proposed Action: It is recommended that the City Council approve the attached resolution authorizing the issuance of a purchase order for the purchase

by many of the seniors enrolled in the City’s senior program in regard to proposed changes to the delivery of services and a tiered membership fee schedule. It is understood that the
City’s budget constraints require creativity in trying to meet resident expectations. This resolution seeks to incentivize participation in the City’s proposed senior programming for
fiscal year 2010-11 by utilizing the benefits offered by the proposed Healthways SilverSneakers Fitness Program (“SilverSneakers”) to offset the out of pocket costs to residents. Under
this proposal seniors who enroll in the SilverSneakers Program and participate in at least 8 fitness sessions at the Community Center, would be able to also enroll in the City’s ITEM

and established throughout Miami-Dade County to provide additional public improvements not covered under the Miami-Dade County Ad Valorem tax. An example of these public improvements
are street lights (acquiring, upgrading, constructing, reconstructing and installing) and special services (maintenance and administration), which could not conveniently or equitably
be provided otherwise to residents of the district. Current Situation According to the Special Taxing Districts Division of Miami-Dade County, approximately 90% of the City is lit under
one of these districts.The remaining 10% are not under a special taxing district and street lights do not exist. For example, the Venetian Gardens neighborhood, which is severly inadequate
lighting levels for a residential community, hence raising safety concerns for the residents and visitors of this neighborhood. Residents have come before the City Council to express
their concerns (Exhibit B – Letter from Venetian Gardens Residents) with the long process to make their community a Special Taxing District To have uniform street light lumens (quanity
of light needed to lumante desired area) across the City will be beneficial for all residents, by making the neighborhoods safe and pedestrian friendly. The cost of the services for
the new areas will be calculated on a front footage along lit roadways basis for each property, as it is calculated for 90% of the homes that are currently under a special taxing district.
A uniform rate per front foot assessment will be applied to all benefitted properties within City boundaries. Proposed Action: That the City Council approve the attached resolution urging
the Miami-Dade County Board of County Commissioners to consolidate the Street Light Special Taxing District in the City of Miami Gardens into one street taxing district and to make the

special taxing districts in 21 various parts of the City, each created prior to the the City’s incorporation; and 22 WHEREAS, now that the City is incorporated, it would be appropriate
for the 23 County to consolidate the street lighting special taxing districts within the City into one 24 district, and to make the entire City a special taxing district for lighting
purposes, and to 25 provide for the intensity upgrade of this street lighting special taxing district; and 26 WHEREAS, consolidating the street lighting special taxing districts into
one 27 district, and including those sections of the City which are not currently served by a 28 street lighting special taxing district will provide uniformity of street lighting in
the City, 29 and will provide for safe and more pedestrian-friendly neighborhoods, 30 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 31 OF MIAMI GARDENS, FLORIDA, AS FOLLOWS:

Hall, project on its own. Staff Summary: Background In 2006, the City purchased the old Wachovia Bank property for building a New City Hall, Police Station and Parking Structure. In
2009, the City received an unsolicited proposal from a development group interested in developing a large portion of the area designated by the City as the “Town Center”. The essence
of the proposal was to develop the private property adjacent to the Wachovia Bank site in conjunction with the construction of a New City Hall, Police Station and Parking Structure.
It was decided to solicit proposals from other potential developers or development teams and to consider other potential locations to satisfy the City’s needs within the Town Center
area. Current Situation City Consultant J. Kevin Lawler, N-K Ventures LC, and Staff prepared specifications to join with a qualified developer or development team in order to construct
a destination Town Center with a New City Hall, Police Headquarters and Parking Structure. The proposal was to be in conjunction with the concurrent development of a property or properties

proposal packages were requested. A pre-proposal meeting was held on July 8, 2010, twenty-seven vendors attended. The proposals were opened on August 16, 2010. One proposal was received
and publicity read. The proposal was received from Miami Gardens Town Center, LLC and LT Enterprises, LLC
a joint venture. A copy of the proposal document and submittal is available at the assistant to the mayor and council’s office for review. A selection/evaluation committee consisting
of Danny Crew, City Manager; Sonja Dickens, City Attorney; and J. Kevin Lawler, N-K Ventures LC, was provided the proposal, copy of the solicitation, and evaluation ranking form. A committee
meeting was held to discuss the ranking process. The Committee agreed to score the proposal in each category with 1) Very Strong; 2) Strong; 3) Moderate; 4) Weak; 5) Unacceptable. A
second meeting was held to discuss individual member’s questions and to determine the consensus of the committee as outlined in Attachment A. Proposed Action: That the City Council provide
the City Manager directions to as to whether to negotiate a joint development proposal with Miami Gardens Town Center, LLC and LT Enterprises, LLC, or for the City to develop the City
