TO THE CITY CLERK; AND 9 PROVIDING FOR AN EFFECTIVE DATE. 10 11 12 WHEREAS, on July 28, 2010, the City Council adopted Resolution No. 13 2010-154-1099 determining a proposed Millage
Rate for the fiscal year 14 commencing October 1, 2010 (“Fiscal Year 2010/2011”), and scheduling the public 15 hearings required by Section 200.065 of the Florida Statutes to be held
on 16 September 8, 2010 at 5:30 p.m., and September 22, 2010, at 6:00 p.m. and 17 WHEREAS, the City Manager has recommended an annual budget for 18 Fiscal Year 2010-2011 commencing October
1, 2010, and 19 WHEREAS, the public and all interested parties will have the opportunity 20 to address address their comments to the City Council and the City Council will consider 21
the comments of the public regarding the proposed millage rate, 22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 23 OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: 24 Section
1. ADOPTION OF REPRESENTATIONS: The foregoing 25 Whereas paragraphs are hereby ratified and confirmed as being true, and the same 26 are hereby made a specific part of this Resolution.

Section 3. ADOPTION OF PROPOSED MILLAGE RATE: The City 1 Council hereby adopts and establishes the proposed millage rate for the City of 2 Miami Gardens for FY 2010/2011 at 6.2728, which
is $6.2728 per $1,000.00 of 3 assessed property within the City of Miami Gardens, Florida. The percent 4 increase of this millage rate over the roll-back rate is 0%. 5 Section 4: ESTABLISHMENT
OF DATE, TIME AND PLACE OF PUBLIC 6 HEARING: The date, time and place of the public hearing to adopt a final millage 7 rate and budget for Fiscal Year 2010/2011 is hereby set for Wednesday
8 September 22, 2010, at 6:00 p.m. at the City of Miami Gardens City Council 9 Chambers, 1515 N.W. 167th Street, Miami Gardens, Florida 33169. 10 Section 4. DIRECTIONS TO THE CITY CLERK:
The City Clerk is 11 directed to advertise said public hearing as required by law and to certified 12 copies of this resolution to the Property Appraiser, Tax Collector, and the Miami-13

ORDINANCE NO. 2010-1 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE 4 CITY OF MIAMI GARDENS, FLORIDA, APPROVING 5 AND ADOPTING THE CITY’S BUDGET FOR THE 2010-6 2011 FISCAL YEAR; PROVIDING

21 “City”) Charter, the City Council is required to adopt an annual budget for the City, and 22 WHEREAS, the City Manager has prepared a tentative budget book, a copy of which 23 is
attached and made a part hereto, that details proposed city expenditures and organizational 24 arrangements for Fiscal Year 2010-2011, and 25 WHEREAS, the proposed Fiscal Year 2010-2011
budget for the City of Miami 26 Gardens, included an estimate of revenues and expenditures, and 27 WHEREAS, the City Manager has provided for various City departments in the 28 budget,
and 29 WHEREAS, the City Council has determined the amount of money which must be 30 raised to conduct the affairs of the City as required by City-operating funds, departments, 31 offices
and agencies for Fiscal Year 2010-2011, so that the business of the City may be 32 conducted on a balanced budget, and 33 Page 8 of 16
WHEREAS, the City Council has also determined the amount necessary to be raised 1 by ad valorem taxes and other taxes or special assessments upon all of the property, real and 2 personal,
within the corporate limits of the City of Miami Gardens, and 3 WHEREAS, public hearings as required by Section 200.065, Florida Statutes, will be 4 held by the City on Wednesday, September
8, 2010 at 5:30 p.m., and Wednesday, September 5 22, 2010, at 6:00 p.m. at City Hall, 1515 N.W. 167th Street, Building 5-200, Miami Gardens, 6 FL 33169, and 7 WHEREAS, said public hearings
have been held as stated above and comments from 8 the public concerning said budget have been heard and considered, and 9 WHEREAS, the amount of funds available from taxation and other
non-ad valorem 10 revenues equals the total appropriations for expenditures and reserves, and 11 WHEREAS, during the course of a budgetary year, the City applies for and/or 12 receives
certain grants and reimbursements, and 13 WHEREAS, the City does not know the dollar dollar amount of the grants or 14 reimbursements that will be awarded at the time that the budget
is approved, and 15 WHEREAS, when grants, reimbursements and donations are awarded and accepted 16 by the City, these funds must be accounted for in the budget, and 17 WHEREAS, it is
more expedient to allow the Resolution accepting the grant or 18 donation to enact the necessary budget transfers and amendments, 19 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL

TOTAL OPERATING REVENUES $154,056,731 1 SECTION 3. EXPENDITURE OF FUNDS: The City Manager is authorized to 2 expend or contract for expenditures, pursuant to the Charter of the City
of Miami Gardens 3 and adopted Code of Ordinances, in accordance with the adopted Fiscal Year 2010-2011 4 Page 12 of 16
budget and budget detail, which is attached hereto and made a part of this ordinance as if it 1 were set forth here in full. 2 SECTION 4. AUTHORIZATION TO THE CITY MANAGER: The City
Manager 3 is hereby authorized and empowered to make budgetary transfers, limited to line item 4 allocations within a single fund, including apportioning budgets within funds to line
items in 5 the Chart of Accounts for the City. Said authority shall include the authority to correct inter-6 fund transfers and accounting allocations. 7 SECTION 5. AUTHORIZATION TO
THE CITY MANAGER: The City Manager 8 is hereby authorized and empowered to amend the budget on an as-needed basis in order to 9 correct typographical errors or omissions that are purely
scriveners’ errors. 10 SECTION 6. AUTHORIZATION TO THE CITY MANAGER: The City Manager 11 is hereby authorized to appropriate unanticipated revenues as deemed necessary. 12 SECTION 7.
AUTHORIZATION TO THE CITY MANAGER: The City Manager 13 is hereby authorized to implement a 1.0% cost-of-living adjustment effective April 1, 2011, 14 for all full-time city employees
including the City Manager, City Attorney and City Clerk. 15 SECTION 8. AUTOMATIC AMENDMENT: The Budget shall be automatically 16 amended upon the adoption of a resolution to accept
a grant or donation of funds or upon 17 issuance of a bond or other municipal debt instrument. 18 SECTION 9. CARRYOVER OF FUNDS: Funds from the City’s Fiscal Year 19 2009-2010 Budget
not expended during Fiscal Year 2009-2010 shall be appropriated to the 20 appropriate fund’s budgeted working capital reserve for Fiscal Year 2010-2011. The 21 budget shall also automatically
re-appropriate any encumbrances and outstanding contracts 22 carried forward from fiscal year 2009-10. 23 Page 13 of 16
SECTION 10. TECHNOLOGY SURCHARGE AND FEE INCREASE: There is 1 hereby imposed a 15% technology surcharge on the cost of all permits and other fees in the 2 Building and Planning & Zoning
departments for Fiscal Year 2010-2011. All building fees 3 shall be increased by 5% for FY-11 as set forth in the Revenue Manual. 4 SECTION 11. INTERFUND TRANSFERS: The City Manager
is authorized to 5 effectuate all interfund transfers anticipated by this budget to include line items classified as 6 ‘Transfers to,’ and ‘Transfers from,’ regardless of fund. 7 SECTION
12. TAX ANTICIPATION NOTES: Upon written recommendation by the 8 Finance Director and approval by the City Attorney, the City Manager is authorized to take any 9 actions necessary to
enter into an agreement with the City's principal depository for the issuance of 10 tax anticipation notes or other appropriate borrowing instruments for the purpose of ensuring an 11
adequate cash flow until such time as sufficient ad valorem taxes have been remitted by the Tax 12 Collector for Miami-Dade County to pay all obligations of the City. The issuance of
such tax 13 anticipation notes or other borrowing is hereby authorized. This arrangement shall not commence 14 prior to October 1st of this year and shall continue no later than January
31st of that same year. The 15 borrowing shall not exceed $6,000,000 in aggregate amount and the interest rate thereon shall not 16 exceed 4%. If the provisions of this section are used,
the City Council shall approve the same by 17 subsequent Resolution, which shall be deemed ministerial in nature. 18 SECTION 12. INSTRUCTIONS TO THE CITY MANAGER: The City Manager is
19 authorized to take all actions necessary to implement the terms and conditions of this 20 Ordinance. 21 SECTION 13. CONFLICT: All ordinances or Code provisions in conflict herewith
22 are hereby repealed. 23 Page 14 of 16
SECTION 14. SEVERABILITY: If any section, subsection, sentence, clause, phrase 1 or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of 2 competent
jurisdiction, such portion shall be deemed a separate, distinct and independent 3 provision and such holding shall not affect the validity of the remaining portions of this 4 Ordinance.
