This applies to all persons who are retained (whether paid or not) to represent a business entity or organization to influence “City” action. “City” action is broadly described to include the ranking and selection of professional consultants, and virtually all-legislative, quasi-judicial and administrative action. All not-for-profit organizations, local chamber and merchant groups, homeowner associations, or trade associations and unions must also register however an annual fee is not required. Staff Summary: This is a public hearing and approval setting the final millage for the FY 10-11 budgetary year. It establishes the operating millage of the roll-back millage rate 6.2728. Proposed Action: Recommend Council approval of the resolution adopting the tentative millage rate for FY 10-11 Attachment: Resolution ITEM D-1) RESOLUTION PUBLIC HEARING Final Millage Rate Page 3 of 68 RESOLUTION NO. 2010-______ A RESOLUTION OF THE CITY OF MIAMI GARDENS, FLORIDA, ADOPTING A FINAL MILLAGE RATE AT A PUBLIC HEARING, FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2010, THROUGH SEPTEMBER 30, 2011; ESTABLISHING THE ROLLBACK RATE; PROVIDING FOR DIRECTIONS TO THE CITY CLERK; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 28, 2010, the City Council adopted Resolution No. 2010-154-1099 determining a proposed Millage Rate for the fiscal year commencing October 1, 2010 (“Fiscal Year 2010/2011”), and scheduling the public hearings required by Section 200.065 of the Florida Statutes to be held on September 8, 2010 at 5:30 p.m., and September 22, 2010, at 6:00 p.m. and WHEREAS, the City Manager has recommended an annual budget for Fiscal Year 2010-2011 commencing October 1, 2010, and WHEREAS, the public and all interested parties have had the opportunity to address their comments to the City Council and the City Council has considered the comments of the public regarding the millage rate, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2. COMPUTATION OF THE ROLLBACK RATE: The roll-back rate for FY 2010/2011 is $6.2728. Section 3. ADOPTION OF FINAL MILLAGE RATE: The City Council hereby adopts and establishes the final millage rate for the City of Miami Gardens Page 4 of 68 for FY 2010/2011 at 6.2728, which is which is $6.2728 per $1,000.00 of assessed property within the City of Miami Gardens, Florida. The percent increase of this millage rate over the roll-back rate is 0%. Section 4: DIRECTIONS TO THE CITY CLERK: The City Clerk is directed to send certified copies of this resolution to the Property Appraiser, Tax Collector, and the Miami-Dade County Board of County Commissioners. Section 5. EFFECTIVE DATE: This resolution shall be effective immediately upon its adoption. Attachment: -Additional Cuts/Revenue FY-2011 Budget -Sample of City Tax Bills ITEM E-1) ORDINANCE SECOND READING/PUBLIC HEARING Proposed FY 2010-2011 Budget Page 7 of 68 1 ORDINANCE NO. 2010-2 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE 5 CITY OF MIAMI GARDENS, FLORIDA, APPROVING 6 AND ADOPTING THE CITY’S BUDGET FOR THE 2010-7 2011 FISCAL YEAR; PROVIDING FOR THE 8 EXPENDITURE OF FUNDS; AUTHORIZING THE CITY 9 MANAGER TO TAKE CERTAIN ACTIONS; PROVIDING 10 FOR CARRYOVER OF FUNDS; PROVIDING A 11 SURCHARGE AND FEE INCREASE FOR PERMITS; 12 PROVIDING FOR INTERFUND TRANSFERS; 13 PROVIDING FOR AUTOMATIC AMENDMENT; 14 PROVIDING FOR ISSUANCE OF TAX ANTICIPATION 15 BOND; PROVIDING FOR ADOPTION OF 16 REPRESENTATIONS; REPEALING ALL ORDINANCES 17 IN CONFLICT; PROVIDING A SEVERABILITY 18 CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. 19 20 21 WHEREAS, in accordance with Section 4.5 of the City of Miami Gardens (the 22 “City”) Charter, the City Council is required to adopt an annual budget for the City, and 23 WHEREAS, the City Manager has prepared a tentative budget book, a copy of which 24 is attached and made a part hereto, that details proposed city expenditures and organizational 25 arrangements for Fiscal Year 2010-2011, and 26 WHEREAS, the proposed Fiscal Year 2010-2011 budget for the City of Miami 27 Gardens, included an estimate of revenues and expenditures, and 28 WHEREAS, the City Manager has provided for various City departments in the 29 budget, and 30 WHEREAS, the City Council has determined the amount of money which must be 31 raised to conduct the affairs of the City as required by City-operating funds, departments, 32 offices and agencies for Fiscal Year 2010-2011, so that the business of the City may be 33 conducted on a balanced budget, and Page 8 of 68 WHEREAS, the City Council has also determined the amount 1 necessary to be raised 2 by ad valorem taxes and other taxes or special assessments upon all of the property, real and 3 personal, within the corporate limits of the City of Miami Gardens, and 4 WHEREAS, public hearings as required by Section 200.065, Florida Statutes, were 5 held by the City on Wednesday, September 8, 2010 at 5:30 p.m., and Wednesday, September 6 22, 2010, at 6:00 p.m. at City Hall, 1515 N.W. 167th Street, Building 5-200, Miami Gardens, 7 FL 33169, and 8 WHEREAS, said public hearings have been held as stated above and comments from 9 the public concerning said budget have been heard and considered, and 10 WHEREAS, the amount of funds available from taxation and other non-ad valorem 11 revenues equals the total appropriations for expenditures and reserves, and 12 WHEREAS, during the course of a budgetary year, the City applies for and/or 13 receives certain grants and reimbursements, and 14 WHEREAS, the City does not know the dollar dollar amount of the grants or 15 reimbursements that will be awarded at the time that the budget is approved, and 16 WHEREAS, when grants, reimbursements and donations are awarded and accepted 17 by the City, these funds must be accounted for in the budget, and 18 WHEREAS, it is more expedient to allow the Resolution accepting the grant or 19 donation to enact the necessary budget transfers and amendments, 20 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE 21 CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: 22 SECTION 1. EXPENDITURE OF FUNDS: The City Manager is authorized to 3 expend or contract for expenditures, pursuant to the Charter of the City of Miami Gardens 4 and adopted Code of Ordinances, in accordance with the adopted Fiscal Year 2010-2011 Page 12 of 68 budget and budget detail, which is attached hereto and made a part 1 of this ordinance as if it 2 were set forth here in full. 3 SECTION 4. AUTHORIZATION TO THE CITY MANAGER: The City Manager 4 is hereby authorized and empowered to make budgetary transfers, limited to line item 5 allocations within a single fund, including apportioning budgets within funds to line items in 6 the Chart of Accounts for the City. Said authority shall include the authority to correct inter7 fund transfers and accounting allocations. 8 SECTION 5. AUTHORIZATION TO THE CITY MANAGER: The City Manager 9 is hereby authorized and empowered to amend the budget on an as-needed basis in order to 10 correct typographical errors or omissions that are purely scriveners’ errors. 11 SECTION 6. AUTHORIZATION TO THE CITY MANAGER: The City Manager 12 is hereby authorized to appropriate unanticipated revenues as deemed necessary. 13 SECTION 7. AUTHORIZATION TO THE CITY MANAGER: The City Manager 14 is hereby authorized to implement a 1.0% cost-of-living adjustment effective April 1, 2011, 15 for all full-time city employees including the City Manager, City Attorney and City Clerk. 16 SECTION 8. AUTOMATIC AMENDMENT: The Budget shall be automatically 17 amended upon the adoption of a resolution to accept a grant or donation of funds or upon 18 issuance of a bond or other municipal debt instrument. 19 SECTION 9. CARRYOVER OF FUNDS: Funds from the City’s Fiscal Year 20 2009-2010 Budget not expended during Fiscal Year 2009-2010 shall be appropriated to the 21 appropriate fund’s budgeted working capital reserve for Fiscal Year 2010-2011. The 22 budget shall also automatically re-appropriate any encumbrances and outstanding contracts 23 carried forward from fiscal year 2009-10. Page 13 of 68 SECTION 10. TECHNOLOGY SURCHARGE AND 1 FEE INCREASE: There is 2 hereby imposed a 15% technology surcharge on the cost of all permits and other fees in the 3 Building and Planning & Zoning departments for Fiscal Year 2010-2011. All building fees 4 shall be increased by 5% for FY-11 as set forth in the Revenue Manual. 5 SECTION 11. INTERFUND TRANSFERS: The City Manager is authorized to 6 effectuate all interfund transfers anticipated by this budget to include line items classified as 7 ‘Transfers to,’ and ‘Transfers from,’ regardless of fund. 8 SECTION 12. TAX ANTICIPATION NOTES: Upon written recommendation by the 9 Finance Director and approval by the City Attorney, the City Manager is authorized to take any 10 actions necessary to enter into an agreement with the City's principal depository for the issuance of 11 tax anticipation notes or other appropriate borrowing instruments for the purpose of ensuring an 12 adequate cash flow until such time as sufficient ad valorem taxes have been remitted by the Tax 13 Collector for Miami-Dade County to pay all obligations of the City. The issuance of such tax 14 anticipation notes or other borrowing is hereby authorized. This arrangement shall not commence 15 prior to October 1st of this year and shall continue no later than January 31st of that same year. The 16 borrowing shall not exceed $6,000,000 in aggregate amount and the interest rate thereon shall not 17 exceed 4%. If the provisions of this section are used, the City Council shall approve the same by 18 subsequent Resolution, which shall be deemed ministerial in nature. 19 SECTION 12. INSTRUCTIONS TO THE CITY MANAGER: The City Manager is 20 authorized to take all actions necessary to implement the terms and conditions of this 21 Ordinance. 22 SECTION 13. CONFLICT: All ordinances or Code provisions in conflict herewith 23 are hereby repealed. Page 14 of 68 SECTION 14. SEVERABILITY: If any section, subsection, sentence, 1 clause, phrase 2 or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of 3 competent jurisdiction, such portion shall be deemed a separate, distinct and independent 4 provision and such holding shall not affect the validity of the remaining portions of this 5 Ordinance. 6 SECTION 15.
