HomeMy WebLinkAbout2020-058-3456 Expedite Building Permits related to COVID-19 RESOLUTION NO. 2020-058-3456 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, DIRECTING THE CITY MANAGER TO EXPEDITE BUILDING PERMITS FOR BUSINESSES THAT ARE COMPLETING RENOVATIONS TO THEIR FACILITY IN ORDER TO SAFEGUARD THE HEALTH AND WELFARE OF THEIR EMPLOYEES AND CUSTOMERS AGAINST COVID-19, PROVIDING FOR ADOPTION OF REPRESENTATIONS, PROVIDING FOR DIRECTION TO THE CITY MANAGER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 9, 2020, Florida Governor Ron DeSantis promulgated Executive Order 20-52 and declared a State of Emergency in Florida in response to COVID-19, and WHEREAS, Executive Order 20-52, Section (4)(D)(1) provides that each municipality in the State of Florida is authorized to waive the procedures and formalities otherwise required of the political subdivision by law pertaining to the taking of whatever prudent action is necessary to ensure the public's health, safety, and welfare, and WHEREAS, under the provisions of law and Sections 252.31-252.60, Florida Statutes, the City of Miami Gardens City Council ratified the Declaration of a Local Emergency signed by Mayor Oliver G. Gilbert, III, on March 11, 2020, and authorized the City Manager, in consultation with the Mayor to take all necessary actions consistent with the Declaration of a Local State of Emergency, and WHEREAS, the effects of Covid-19 continue to require extraordinary and immediate actions by the City of Miami Gardens in order to protect the public's health, safety and welfare, and WHEREAS, on April 29, 2020, Governor Ron DeSantis issued executive order 20-112 initiating phase 1 of the Safe. Smart. Step-by-Step. Plan for Florida's Recovery and authorized Miami-Dade County to enter into phase 1 of the state's recovery plan on May 14, 2020 pursuant to executive order 20-122, and WHEREAS, on May 15, 2020, Mayor Gilbert issued emergency order 20-03 authorizing certain businesses licensed in the City of Miami Gardens to re-open with operational conditions in order to protect employees and customers, and WHEREAS, business may need to make certain renovations that may require permitting in order to be compliant with state and local order related to COVID-19 WHEREAS, the Councilwoman Katrina Wilson deems it appropriate to direct City Manager to expedite building permits for building renovations required by City of Miami Gardens businesses in order to meet the recommended guidelines of the Centers for Disease Control and Prevention (CDC) to safeguard the health and welfare for their employees and customers alike, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: DIRECTION TO THE CITY MANAGER: The Mayor and City Council hereby directs the City Manager to expedite building permits for building renovations required by businesses in order to meet the recommended guidelines of the Centers for Disease Control and Prevention (CDC) to safeguard the health and welfare for their employees and customers alike. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
