A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA APPROVING THE APPLICATION
SUBMITTED BY GRAHAM PENN ON BEHALF OF ONE FISH,
LLC, FOR THE PROPERTY LOCATED AT 16555 NW 13TH
AVENUE, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"
ATTACHED HERETO, FOR A VARIANCE OF SECTION 34-342
OF THE LAND DEVELOPMENT REGULATIONS TO WAIVE
THE REQUIREMENT OF A MINIMUM REAR SETBACK OF
TWENTY (20) FEET; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Graham Penn on behalf of One Fish, LLC ("Applicant") has applied
for a Non-Use Variance from the City of Miami Gardens ("City") to decrease the
minimum rear setback from twenty (20) feet to eight (8) feet, and
WHEREAS, the subject property is located at 16555 NW 13th Avenue, within I-
1 - Light Industrial, more particularly described in Exhibit "A" attached hereto, and
WHEREAS, Section 34-342 — Table 2, of the City's Land Development
Regulations, requires a minimum rear setback requirement within 1-1 - Light Industrial of
20 feet, and
WHEREAS, the City's Planning and Zoning Staff recommends approval of the
application for a non-use variance to allow a decrease in the minimum rear setback
from twenty (20) feet to eight (8) feet, and
WHEREAS, the City Council considered the testimony of the Applicant, if any,
and
WHEREAS, the City Council also considered the testimony of the City's Planning
and Zoning Staff, and the Staff Report attached hereto as Exhibit "B" is hereby
incorporated by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: APPROVAL: The City Council of the City of Miami Gardens hereby
approves the application submitted by Graham Penn on behalf of One Fish, LLC for a
variance of Section 34-342 — Table 2 of the Land Development Regulations waiving the
requirement of a minimum rear setback of twenty (20) feet.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON J LY 22, 2020.
