A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA APPROVING THE APPLICATION
SUBMITTED BY GREGG HALL ON BEHALF OF FLORIDA
POWER & LIGHT COMPANY ("FPL"), FOR THE PROPERTY
LOCATED AT 3875 NW 203RD STREET, MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED
HERETO, FOR A VARIANCE OF SECTION 34-446 OF THE
LAND DEVELOPMENT REGULATIONS TO WAIVE THE
MAXIMUM WALL HEIGHT RESTRICTION OF SIX (6) FEET;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Gregg Hall on Behalf of FPL ("Applicant") has applied for a Non-Use
Variance from the City of Miami Gardens ("City") to increase the maximum wall height
from six (6) feet to ten (10) feet, and
WHEREAS, the subject property, FPL Snake Creek Substation, is located at
3875 NW 203rd Street within R-1 Single Family Dwelling Residential, more particularly
described in Exhibit "A" attached hereto, and
WHEREAS, Section 34-446 (g) of the Land Development Regulations permits a
maximum fence/wall height of six (6) feet within an R-1 Zoning District, and
WHEREAS the Applicant proposes constructing a ten (10) foot wall around the
substation to screen equipment from the surrounding properties,
WHEREAS, the City's Planning and Zoning Staff recommends approval of the
application for a non-use variance to allow an increase in the maximum wall height from
six (6) feet to ten (10) feet, and
WHEREAS, the City Council considered the testimony of the Applicant, if any,
and
WHEREAS, the City Council also considered the testimony of the City's Planning
and Zoning Staff, and the Staff Report attached hereto as Exhibit "B" is hereby
incorporated by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: APPROVAL: The City Council of the City of Miami Gardens hereby
approves the application submitted by Gregg Hall on Behalf of FPL for a variance of
Section 34-446 of the Land Development Regulations waiving the maximum wall height
restriction of six (6) feet.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS AT ITS REGULAR MEETING HELD ON JULY 22, 2020.
