A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST
RESPECTIVELY THE MEMORANDUM OF UNDERSTANDING
(MOU) WITH THE DADE COUNTY POLICE BENEVOLENT
ASSOCIATION, INC. ("POLICE UNION") AND MIAMI DADE
COUNTY AUTHORIZING A ONE PERCENT (1%) PAY
ADJUSTMENT TO FIRST RESPONDERS RETROACTIVE TO
MARCH 1, 2020 TO THE LAST DATE OF THE COVID-19
PUBLIC HEALTH EMERGENCY DECLARATION OR
DECEMBER 30, 2020, WHICHEVER DATE IS EARLIER FROM
THE CITY'S CARES ACT FUNDING, SUBJECT TO THE
APPROVAL OF MIAMI-DADE COUNTY; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in response to public health emergency created by the COVID-19
pandemic, the United States Congress passed legislation, the Coronavirus Aid, Relief
and Economic Securities Act or CARES Act, which provided a relief fund for state, local
and tribal governments to assist in responding to the COVID-19 public health
emergency, and
WHEREAS, the federal government agreed to provide additional funding to cities
through reimbursement of funds directly paid to the counties where such cities are
located, and
WHEREAS, the CARES Act provides for a temporary, one percent (1%) pay
adjustment to first responders retroactive to March 1, 2020 to the last date of the
COVID-19 public health emergency declaration or December 30, 2020, whichever date
is earlier, and
WHEREAS, City of Miami Gardens police officers, who physically worked to
mitigate or respond to the COVID-19 pandemic, are eligible for the one percent (1%)
temporary, one-time pay adjustment, and
WHEREAS, Miami-Dade County will reimburse and fund this pay adjustment
pursuant to the provisions of the CARES Act, and
WHEREAS. the Dade County Police Benevolent Association, Inc. ("Police
Union"), as the bargaining unit and representative of police officers in various cities
within Miami-Dade County, negotiated a memorandum of understanding acceptable to
the cities and Miami-Dade County, and
WHEREAS, the 1% pay adjustment shall be paid for hours physically worked
dedicated to mitigating or responding to the pandemic, and
WHEREAS, the pay adjustment will not be allowed for police officers who are not
in pay status or for any unworked pay hours including, but not limited to Annual Leave,
Educational Leave, Jury Duty and Sick Leave not related to COVID-19, and
WHEREAS, the 1% pay adjustment shall not be paid on any leave or separation
payouts or for DROP payouts, and
WHEREAS, the parties agree that this 1% pay adjustment is subject to
reimbursement by Miami-Dade County and should the County not fulfill its payment
obligations, then the Memorandum of Understanding is null and void, and
WHEREAS, it is recommended that the Memorandum of Understanding be
approved, and
WHEREAS, the Memorandum of Understanding has been accepted by Miami-
Dade County as appropriate for reimbursement of the 1% pay adjustment, and
WHEREAS, the Memorandum of Understanding is effective and valid only if
Miami-Dade County reimburses the City for the 1`)/0 pay adjustment, and
WHEREAS, the Police Union has agreed that absent reimbursement by Miami-
Dade County, the police officers would not be entitled to the 1% pay adjustment,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest
respectively the Memorandum of Understanding (MOU) with the Dade County Police
Benevolent Association, Inc. ("Police Union") and Miami Dade County. The City Council
further authorizes a one percent (1%) pay adjustment to first responders retroactive to
March 1, 2020 to the last date of the Covid-19 Public Health Emergency Declaration or
December 30, 2020, whichever date is earlier, subject to the approval of Miami-Dade
County.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
