A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY ATTORNEY TO TAKE ANY AND
ALL STEPS NECESSARY IN ORDER TO VACATE A RIGHT-
OF-WAY LOCATED AT NW 156TH STREET & NW 30TH
AVENUE, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING
FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami Gardens owns an unused portion of right-of-way
located at NW 156th Street & NW 30th Avenue as shown in Exhibit 'A", and
WHEREAS, the adjacent property owners have submitted a request for this
portion of the right-of-way to be vacated and deeded back, and
WHEREAS, as part of the due diligence, letters of no objection have been
obtained from all utility service providers as attached in Exhibit "B", to include North
Miami Beach Water, AT&T, Florida City Gas, Florida Power & Light (FPL), Comcast and
the South Florida Water Management District, and
WHEREAS, Staff recommends that the City Council authorize the City Manager
and the City Attorney to take any and all steps necessary in order to vacate the
referenced right-of-way,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Attorney to take any and all steps
necessary in order to vacate a Right-of-Way located at NW 156th Street & NW 30th
Avenue.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
