HomeMy WebLinkAbout2021-034-3589_-_2022_Jazz_in_the_Gardens_-_Adopted.docxRESOLUTION NO. 2021-034-3589 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE 2022 JAZZ IN THE GARDENS EVENT; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL CONTRACTS AS MAY BE NECESSARY AND APPROPRIATE FOR THE PRODUCTION OF THE 15TH ANNUAL JAZZ IN THE GARDENS EVENT TO BE HELD IN MARCH 2022; PROVIDING FOR A WAIVER OF BID PROCEDURES FOR PURCHASES MADE IN CONNECTION WITH THE EVENT; AUTHORIZING THE CITY MANAGER TO EXCEED HIS PURCHASING AUTHORITY AS MAY BE NECESSARY FOR THE EVENT; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Jazz in the Gardens Music Festival, held annually at Hard Rock Stadium, is not just a concert; it is a high-class event that has put the City of Miami Gardens on the map as a thriving City and destination, showcasing our people, community, and businesses, and WHEREAS, the Jazz in the Gardens Music Festival has become one of the premier spring events in the southeastern region of the United States, ranked as one of the top festivals “… You need to attend in 2019” by Essence.com and "10 Best Music Festivals in Florida" by DailyMusicRoll.com in February 2021, and WHEREAS, based on the overwhelming response received in past years, Jazz in the Gardens is strategically positioned to increase the City’s recognition and visibility, and WHEREAS, in an abundance of caution, the festival did not occur in 2020 and 2021 due to the COVID-19 pandemic, and WHEREAS, to date, we are experiencing a turn for the better, so it is critical to begin planning for 2022 to secure artists and solicit national sponsors, and WHEREAS, it is the staff’s goal to have a production contract executed no later than May 2021, and WHEREAS, during this timeframe, discussions with advertised 2020 festival talent will begin, and WHEREAS, we anticipate that performing artists, advertising, marketing and production expenditures in several areas will exceed the City Manager's authority as prescribed under the City’s Purchasing Ordinance, and DocuSign Envelope ID: 9ED6C826-0B58-4392-8442-0F14B53CEB4A Page 2 of 3 Resolution No. 2021-034-3589 WHEREAS, if staff is required to bring each of these matters back to Council for approval, we would have difficulty negotiating the various agreements for these services in a timely manner, and WHEREAS, City Staff request authorization to allow the City Manager to exceed his purchasing authority, as it relates to all expenditures related to the 2022 Jazz in the Gardens events, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves the 2022 Jazz in the Gardens Music Festival; authorizes the City Manager to negotiate and execute all contracts as may be necessary and appropriate for the production of the Jazz in the Gardens event to be held in 2022; waives of bidding procedures for purchases made in connection with the event; and authorizes the City Manager to exceed his purchasing authority as may be necessary for the event. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
