A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI 4 GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO 5 EXECUTE A UTILITY EASEMENT TO FLORIDA
POWER AND 6 LIGHT COMPANY TO PROVIDE ELECTRIC
SERVICE TO THE 7 NEW PUMP STATION AT BENNETT
LIFTER PARK; ATTACHED 8 HERETO AS EXHIBIT “A”;
PROVIDING FOR THE ADOPTION OF 9 REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in 2013, Miami Dade County entered into a Consent Decree which
required the existing pump station be upgraded for continuity of service to existing
properties; to provide for increased flows from possible future development; and for
minimizing future repairs of the pump station and associated infrastructure, and
WHEREAS, in upgrading the lift station, it was relocated to Bennett Lifter Park with
direct access off of NW 207 Street which benefits the City in minimizing disruptions to
park property when service or repair work is needed, and
WHEREAS, permanent easement is required for Florida Power & Company to
install required underground utility and above ground transformer to provide service to
the new/relocated sanitary sewer pump station (PS0444) at Bennett Lifter Park, and
WHEREAS, Staff recommends that the City Council approve the easement to
Florida Power and Light,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
authorizes the City Manager to execute a utility easement to Florida Power and Light
Company to provide electric service to the new pump station at Bennett Lifter Park.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON APRIL 28, 2021.
