HomeMy WebLinkAbout2021-052-3607_-_Right-of-Way_-_The_Experts_LLC_Multifamily_Development_Project_-_Adopted.docxRESOLUTION NO. 2021-052-3607 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE VACATION OF THE UNUSED PORTION OF THE NW 177TH STREET RIGHT- OF-WAY LOCATED EAST OF NW 25TH AVENUE AND WEST OF NW 27TH AVENUE, AND ANY UNDERLYING UTILITY EASEMENTS, AND IN EXCHANGE ACCEPTING THE DEDICATION OF A RIGHT-OF-WAY ALONG NW 25TH AVENUE SOUTH OF NW 177TH STREET DESCRIBED ON EXHIBITS “A”,“B”,“C”AND ‘D.’;PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami Gardens owns an unused portion of right-of-way located at NW 177th Street between NW 25th Avenue and NW 27th Avenue as shown in 'Exhibit A', and WHEREAS, The Experts LLC owns the land immediately South of the right-of- way and plan to construct a market rate multi-family development on their site, and WHEREAS, The Experts LLC seeks vacation of the City's unused portion of the NW 177th Street right-of-way so it may incorporate it into its property, and WHEREAS, in accordance with the original right-of-way deed, the vacated right- of-way will revert back to Mt Hermon AME Church of Opa Locka. Mt Hermon in turn will then deed the vacated right-of-way to The Experts LLC through a separate agreement between the two parties, and WHEREAS, in exchange for the vacation, the developer for The Experts LLC will dedicate the eastern portion of their parcel to the City to make expansion of the public right-of-way along NW 25th Avenue possible as shown in 'Exhibit B', and WHEREAS, the agreement deeding the eastern portion of the development to the City to expand the new right-of-way along NW 25th Avenue is shown in 'Exhibit D', and WHEREAS, as part of the due diligence, letters of no objection have been obtained from all utility service providers including North Miami Beach Water, AT&T, Florida City Gas, Florida Power & Light (FPL) and Comcast as attached in 'Exhibit C', and WHEREAS, staff recommends City Council approve the vacation of the unused portion of the NW 177th Street right-of-way located East of NW 25th Avenue and West of NW 27th Avenue, and any underlying utility easements, and in exchange authorize the acceptance of the dedication of right-of-way along NW 25th Avenue South of NW 177th Street, DocuSign Envelope ID: 9ED6C826-0B58-4392-8442-0F14B53CEB4A Page 2 of 2 Resolution No. 2021-052-3607 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing “WHEREAS” paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: APPROVAL: the City Council approves the vacation of the unused portion of the NW 177th Street right-of-way located East of NW 25th Avenue and West of NW 27th Avenue, and any underlying utility easements, and in exchange accepts the dedication of right-of-way along NW 25th Avenue South of NW 177th Street, as shown on EXHIBITS ‘A’, ‘B’, ‘C’ and ‘D.’ Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
