HomeMy WebLinkAbout2021-061-3616_-_Interlocal_Agreement_with_MDC_for_Traffic_Control_Services_-_Adopted.docxRESOLUTION NO. 2021-061-3616 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST RESPECTIVELY, THAT CERTAIN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY TO ASSUME CERTAIN TRAFFIC CONTROL AND ENGINEERING SERVICES INCLUDING THE INSTALLATION AND MAINTENANCE OF TRAFFIC CALMING DEVICES PERTAINING TO ITS LOCAL MUNICIPAL STREETS, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami Gardens routinely receives complaints from residents related to traffic issues with speeding being a top concern, and WHEREAS, in 2004 the City of Miami Gardens and Miami-Dade County entered into an Interlocal Agreement (see herein attached Exhibit “A”) providing in part that: The right and responsibility to regulate traffic and determine appropriate measures for and provide traffic control devices such as traffic signals, signs and pavement markings, including road closures (except for temporary closures for special events) or traffic-calming devices and setting the hours and days that construction by any Department or Agency of the County in or any public street is not transferred to the City. The County retains jurisdiction over traffic engineering matters within the territorial area of Miami-Dade County including within municipalities, except state road rights of way. and, WHEREAS, the Public Works Department recommends the City Council authorize the City Manager to execute an Interlocal Agreement with Miami-Dade County to assume certain traffic control and engineering services including the installation and maintenance of traffic calming devices pertaining to its local municipal streets, and WHEREAS, per the requested Interlocal Agreement, Miami- Dade County will retain authority to approve or deny the City’s request for traffic calming devices, and WHEREAS, City will continue to follow the County’s Speed Bump Policy as provided in the hereby attached Exhibit “C”, and WHEREAS, any expenditures associated with assuming certain traffic control devices will be funded under the CITT budget funds redirected from the existing road resurfacing and sidewalk improvement CITT budgeted amount, and DocuSign Envelope ID: E3A5248E-0AC6-4EE4-8765-D7C8E74762A7 Page 2 of 3 Resolution No. 2021-061-3616 WHEREAS, the estimated amount of funds needed will be based on the device requests and the actual recommended traffic calming device(s). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing “WHEREAS” paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby authorizes the City Manager and the City Clerk to execute and attest respectively, that certain Interlocal Agreement with Miami-Dade County to assume certain traffic control and engineering services including the installation and maintenance of traffic calming devices pertaining to its local municipal streets, a copy of which is attached hereto as Exhibit "A." Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby authorized to obtain two (2) fully executed copies of the subject Agreement with one to be maintained by the City, and one to be delivered to Miami Dade County. Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
