HomeMy WebLinkAbout2021-079-3634_-_Air_Park_Warehouse_Setback_Variance_-_Adopted.docxRESOLUTION NO. 2021-079-3634 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE APPLICATION SUBMITTED BY STEPHANE W LOISEAU ON BEHALF OF TANJA LAND 712 LLC, TO REDUCE THE SIDE SETBACK TO 2 FEET WHERE THE MINIMUM ALLOWABLE IS 7.5 FEET AND TO REDUCE THE REAR SETBACK TO 4 FEET WHERE THE MINIMUM ALLOWABLE IS 20 FEET, FOR THE PROPOSED AIR PARK WAREHOUSE PROJECT ON THE PROPERTY LOCATED ON NW 37TH AVENUE AND NW 154TH TERRACE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Applicant, Stephane W. Loiseau is requesting a non-use variance of Section 34-342 - Tables for Development Standards, on behalf of Tanja Land 712 LLC, and WHEREAS, the request is to reduce the side setback to 2 feet where the minimum allowable is 7.5 feet and to reduce the rear setback to 4 feet where the minimum allowable is 20 feet for the proposed Air Park Warehouse Project, and WHEREAS, the proposed Air Park Warehouse Project is located on NW 37TH AVENUE and NW 154TH TERRACE, described in Exhibit “A” and identified by Folio No. 34-2116-014-0070, and WHEREAS, the land is currently vacant, undeveloped and in an area surrounded by light industrial warehouses adjacent to the Opa-Locka Airport, and WHEREAS, all other development standards are intended to be met and the structure will otherwise be consistent with the current code and with the surrounding warehouses, and WHEREAS, the City’s Planning and Zoning staff has reviewed the Application and the Staff Recommendation is attached hereto as Exhibit “C”, and WHEREAS, Staff recommends approval of this Resolution to allow a variance to reduce the side setback to 2 feet where the minimum allowable is 7.5 feet and to reduce the rear setback to 4 feet where the minimum allowable is 20 feet for the proposed Air Park Warehouse Project, on the property identified by Folio Number 34-2116-014-0070. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: DocuSign Envelope ID: 135D8982-63D6-4C5F-A26E-BCB38F63E3F1 Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves the application submitted by Stephane W. Loiseau, to reduce the side setback to 2 feet where the minimum allowable is 7.5 feet and to reduce the rear setback to 4 feet where the minimum allowable is 20 feet for the proposed Air Park Warehouse Project located on NW 37TH AVENUE and NW 154TH TERRACE, described in Exhibit “A” and identified by Folio No. 34-2116-014-0070. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
