A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY, THAT CERTAIN EASEMENT AGREEMENT
WITH MIAMI-DADE COUNTY TO UPGRADE PUMP STATION
444 WITHIN BENNET LIFTER PARK, A COPY OF WHICH IS
ATTACHED HERETO AS EXHIBIT “A”; PROVIDING FOR
INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in 2013, Miami Dade County (hereinafter “County”) entered into a
Consent Decree with the United States Environmental Protection Agency, the State of
Florida, and the Florida Department of Environmental Protection that requires the County
to upgrade its wastewater collection and transmission system, including pump stations
and force mains, and
WHEREAS, the Miami-Dade Water and Sewer Department (hereinafter “WASD”)
owns and operates Pump Station 444 which is located within Bennet Lifter Park, and
WHEREAS, the pump station must be upgraded to comply with the Consent
Decree, and
WHEREAS, the City of Miami Gardens (hereinafter “City”) mutually agreed with
WASD that relocating the pump station with direct access off of NW 207 Street benefits
the City in minimizing disruptions to park property when service or repair work is needed,
and
WHEREAS, permanent easements are needed to complete the installation of
underground utilities, and
WHEREAS, a temporary construction easement is needed for WASD contractors
to construct the new upgrade, and
WHEREAS, City Staff recommends City Council authorize the City Manager to
execute the Easement Agreement with WASD,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest respectively,
that certain Easement Agreement with Miami-Dade County to upgrade Pump Station 444,
a copy of which is attached hereto as Exhibit “A”.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON JULY 28, 2021.
