A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY THAT CERTAIN INTERLOCAL AGREEMENT
WITH MIAMI-DADE COUNTY FOR THE ILLEGAL DUMPING
PILOT PROGRAM; A COPY OF WHICH IS ATTACHED HERETO
AS EXHIBIT “A”; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on May 24, 2021, the Board of County Commissioners passed Miami-
Dade County (hereinafter “County”) Resolution No. R-452-21, sponsored by Vice Chair
Oliver Gilbert, and
WHEREAS, the Resolution created a one-year Illegal dumping pilot program for
the City of Miami Gardens (hereinafter “City”) to collect, transport, and deposit qualifying
illegally dumped debris at designated County facilities, at no cost to the County, and
WHEREAS, should the County fail to complete this process by picking up the
illegal debris within three (3) calendar days, the City may collect and transport the material
to a Department of Solid Waste Management (hereinafter “DSWM”) disposal site and
charge the cost to the County account, and
WHEREAS, training will be provided by the County’s DSWM to City Staff and
enforcement will be conducted under the City’s municipal code, and
WHEREAS, City Staff recommends the City Council authorize the City Manager
to execute this Interlocal Agreement with Miami-Dade County for the Illegal dumping pilot
program, a copy of which is attached hereto as Exhibit “A”,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest, respectively,
that certain Interlocal Agreement with Miami-Dade County for the Illegal Dumping Pilot
Program, a copy of which is attached hereto as Exhibit “A”.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
