HomeMy WebLinkAbout2022-014-3727_-_Request_for_Proposal_(RFP)_CBRE_Building_Opportunities_Residential_and_Commercial_PrRESOLUTION NO. 2022-014-3727 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AWARDING REQUEST FOR PROPOSAL- BUILDING OPPORTUNITY SALE OF CITY OWNED PROPERTY FOR THE DEVELOPMENT OF THE PROPERTY IDENTIFIED AS FOLIO NO. 34-2116-013-0080 TO LEGACY DEVELOPMENT ALLIANCE; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on August 17, 2020, Request for Proposal (RFP) – for the “Building Opportunity” sale of City Owned Property was solicited, and WHEREAS, the RFP invited qualified firms to submit proposals for development opportunities on thirteen individual parcels of land, which included six residential parcels and seven commercial parcels located throughout the City, and WHEREAS, in response to the RFP, commercial proposals were received from six (6) proposers; Ambrose Property Group, Genet EquiShares, Legacy Development Alliance, Miami Gardens Charter School, Sunshine Meat & Beverage, and US Association of CDC, Inc., and WHEREAS, on March 30, 2021 an Evaluation Committee meeting was held and the Evaluation Committee scored and ranked the firms shortlisting two firms: Legacy Development Alliance and Sunshine Meat & Beverage, for the property identified as Folio No. 34-2116-013-0080 and generally located at 15880 NW 27th AVE, Miami Gardens, FL, and WHEREAS, subsequently on April 20, 2021, the firms were invited to an Evaluation Committee presentation meeting to provide additional insight on their proposals and answer any questions posed by the Evaluation Committee. The Evaluation Committee observed the presentations and ranked both firms resulting in a tie, and WHEREAS, Section 2-758(e) of the Procurement Code provides “If a tie occurs between two or more local businesses, for those contracts that are to be awarded by the city manager, the city manager shall determine to whom the bid will be awarded. For those contracts to be awarded by the city council, the city council shall determine to whom the bid will be awarded” and WHEREAS, on February 9, 2022, the City Council heard oral presentations from Legacy Development Alliance and Sunshine Meat & Beverage, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: DocuSign Envelope ID: 4C07ACC4-FC37-441C-B057-59E3117877C3 Page 2 of 2 Resolution No. 2022-014-3727 Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby authorizes the City Manager to negotiate a contract with Legacy Development Alliance for the property identified as Folio No. 34-2116-013-0080 generally located at 15880 NW 27th AVE, Miami Gardens. The City Council further authorizes the City Manager to negotiate a purchase and sale agreement with Legacy Development Alliance for this purpose, and to bring the negotiated contract back to the City Council for approval. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
