A RESOLUTION OF THEA RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA,
AUTHORIZING THE CITY MANAGER AND CITY CLERK TO
EXECUTE AND ATTEST TO RESPECTIVELY THOSE CERTAIN
AGREEMENTS ATTACHED HERETO AS EXHIBIT “A” AND “B”
FOR THE CITY’S CONSENT AND ACKNOWLEDGEMENT OF
THE ASSIGNMENT FROM RG TOWERS, LLC TO CASTLE
TOWERS 06-2 LLC OF THOSE CERTAIN LICENSES
AGREEMENT ENTERED INTO ON MARCH 13, 2018;
ATTACHED HERETO AS EXHIBIT “C” AND “D” LICENSING OF
A PORTION OF REAL PROPERTY AT THE BETTY T.
FERGUSON RECREATION CENTER AND AT ROLLING OAKS
PARK FOR OF CONSTRUCTION, MAINTENANCE AND
OPERATION OF A WIRELESS TELECOMMUNICATIONS
FACILITY IN SUBSTANTIAL FORM AS THAT AGREEMENT,
PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on March 13, 2018 the City of Miami Gardens and RG Towers LLC
entered into two License Agreements regarding real property at the Betty T. Ferguson
Recreation Center and at Rolling Oaks Park, hereto attached as Exhibits “C” and “D”, and
WHEREAS, per the attached License Agreements with RG Towers, LLC, the City
granted the licensing of a certain portion of real property at the Betty T. Ferguson
Recreation Center and at Rolling Oaks Park for access and utility easement for
constructing, maintaining and operating of a wireless telecommunications facility in
substantial form, and
WHEREAS, the City, RG Towers, LLC and Crown Castle Towers 06-2 LLC now
seek to enter into agreements for the City’s consent and acknowledgement of the
assignment of those certain license agreements from RG Towers, LLC to Castle Towers
06-2 LLC, hereto attached as Exhibits “A” and “B” and
WHEREAS, it is recommended that the City Council approve the attached
agreements for the City’s consent and acknowledgement of the assignment of those
certain license agreements from RG Towers, LLC to Castle Towers 06-2 LLC for the
licensing of a certain portion of real property at the Betty T. Ferguson and Recreation
Center and at Rolling Oaks Park, and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:

Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes that the City Manager and the City Clerk execute and attest
respectively the attached agreements for the City’s consent and acknowledgement of the
assignment of those certain license agreements from RG Towers, LLC to Castle Towers
06-2 LLC for the licensing of a certain portion of real property at the Betty T. Ferguson
and Recreation Center and at Rolling Oaks Park, hereto attached as Exhibits “A” and “B.”
Section 3. INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
directed to obtain three (3) fully executed copies of the subject Agreement with one to be
maintained by the City, one to be delivered to Scott Richards, of RG Towers, LLC and
one to be delivered to Jonathan Angel, of Castle Towers 06-2 LLC.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON JANUARY 26, 2022.
