A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO EXECUTE A WATER AND SANITARY SEWER
FACILITIES AGREEMENT WITH THE MIAMI DADE COUNTY
WATER AND SEWER DEPARTMENT, A COPY OF WHICH IS
ATTACHED HERETO AS EXHIBIT “A”, TO PROVIDE UTILITY
SERVICES TO THE NEW BENNETT LIFTER PARK; PROVIDING
FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, in April 2014, the City of Miami Gardens (“City”) residents approved a
General Obligation Bond (GOB) in the amount of sixty million dollars ($60,000,000) for
the construction of and improvements to the City’s parks and related facilities, and
WHEREAS, City Council approved ENCO LLC proposal response for RFP 15-16-
047 Bennett Lifter Park Improvements for work including overall site improvements, new
playground, and renovations of the existing community center, and
WHEREAS, the existing building was demolished and a new facility with larger
meeting space, new water and sewer connections, and added outdoor space was
determined to better serve Bennett Lifter Park, and
WHEREAS, change orders were added via Resolutions 2021-018-3573 and 2021-
098-3653 for the design and construction of a new Community Center, and
WHEREAS, the new building will utilize additional water and sewer capacity which
is beyond the usage allocated in the original Agreement with Miami Dade County (“MDC”)
(ID# 23687), attached hereto as Exhibit “B”, and
WHEREAS, MDC generated a new Agreement (ID# 23687a) outlining
construction, operations, and terms for any redevelopment that affect their infrastructure
and to furnish an Opinion of Title, and
WHEREAS, City Staff recommends that the City Council authorize the City
Manager to execute a Water and Sanitary Sewer Facilities Agreement with the Miami
Dade County Water and Sewer Department, a copy of which is attached hereto as Exhibit
“A”, to provide utility services to the new Bennett Lifter Park,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager to execute a Water and Sanitary Sewer Facilities
Agreement with the Miami Dade County Water and Sewer Department, a copy of which
is attached hereto as Exhibit “A”, to provide utility services to the new Bennett Lifter Park.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON MARCH 9, 2022.
