A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE WAIVER OF
MINIMUM REQUIREMENTS FOR RECREATION/PLAY AREAS
FROM 42,000 SQUARE FEET TO 1,634 SQUARE FEET FOR
THAT CERTAIN PROPERTY LOCATED AT 18441 NW 2ND
AVENUE, MIAMI GARDENS, FLORIDA, MORE PARTICULARLY
DESCRIBED IN EXHIBIT “A” ATTACHED HERETO, AS SET
FORTH IN SECTION 34-288 OF THE CITY OF MIAMI GARDENS
CODE OF ORDINANCES; PROVIDING FOR CONDITIONS;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, St. Anthony School (“Applicant”) is an educational facility located at
18441 NW 2nd Avenue, in Miami Gardens serving approximately 100 students in grades
1 thru 12 that has been operating in the City without a required Zoning Certificate of Use
(CU), and
WHEREAS, the Applicant is required to provide approximately 42,000 square feet
of recreation/play area and, currently, the school does not meet the requirement, and
WHEREAS, the current floorplan of the school provides for only 1,634 square feet
of indoor recreation/play area and no outdoor recreation area, and
WHEREAS, to come into compliance, St. Anthony School is requesting a waiver
of the requirement for recreation/play area pursuant to Sec. 34-47 of the City Code of
Ordinances, and
WHEREAS, the City Council has considered the testimony of the Applicant, if any,
and the Staff Report attached hereto as Exhibit “B” and incorporated by reference, and
WHEREAS, Staff recommends that City Council approve the waiver of
recreation/play area minimum requirements from 42,000 square feet to 1,634 square feet
as requested by Applicant subject to a condition that Applicant be required to provide
outdoor recreation to students at a local park a minimum of 3 days per school week,
weather permitting, in accordance with State law requirements,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves the waiver of minimum requirements for recreation/play areas from
42,000 square feet to 1,634 square feet for that certain property located at 18441 NW
2nd Avenue, Miami Gardens, Florida, more particularly described in Exhibit “A” attached
hereto, as set forth in Section 34-288 of the City of Miami Gardens Code of Ordinances.
Section 3: CONDITION: This approval is subject to the condition that Applicant be
required to provide outdoor recreation to students at a local park a minimum of 3 days
per school week, weather permitting, in accordance with State law requirements.
