A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO TERMINATE THE DESIGN BUILD AGREEMENT
WITH ENCO, LLC AND NEGOTIATE AND EXECUTE AN
AGREEMENT WITH GULF BUILDINGS, LLC, FOR THE DESIGN,
CONSTRUCTION, AND RECONSTRUCTION OF BENNETT
LIFTER PARK; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on November 9, 2016, City Council approved and awarded the bid to
ENCO, LLC for the design, construction, and reconstruction of Bennett Lifter Park and
authorized the City Manager to negotiate and execute an agreement for this purpose, and
WHEREAS, on March 8, 2022, ENCO issued a letter stating that due to current
market conditions, ENCO, LLC would not be proceeding with the construction work for
which a price had been previously provided, and requested that the City cancel the Design
Build Agreement for the construction of Bennett Lifter Park, and
WHEREAS, upon terminating the Agreement, the City will enter into negotiations
with the second ranked firm, Gulf Building, LLC, and
WHEREAS, City Staff recommend that the City Council authorize the City Manager
to terminate the Design Build Agreement with ENCO, LLC and negotiate and execute an
Agreement with Gulf Buildings, LLC, for the design, construction, and reconstruction of
Bennett Lifter Park,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager to terminate the Design Build Agreement with ENCO,
LLC and negotiate and execute an Agreement with Gulf Buildings, LLC, for the design,
construction, and reconstruction of Bennett Lifter Park.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON MARCH 23, 2022.
