A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE THAT CERTAIN
AGREEMENT WITH AIP US, LLC FOR THE LEASE WITH AN
OPTION TO BUY OF CISCO NETWORK EQUIPMENT
(DETAILED ON QUOTE #20211129) FOR AN AMOUNT NOT TO
EXCEED NINETY NINE THOUSAND, EIGHT HUNDRED AND
THIRTY FOUR DOLLARS AND TWENTY SEVEN CENTS
($99,834.27) ANNUALLY, FOR TWO YEARS, BY RELYING ON
PARTICIPATION AGREEMENT# 43220000-NASPO-19-ACS;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 22nd 2013 the Information Technology Department
purchased Cisco Network equipment for both the City Hall and the Police Department,
and
WHEREAS, the network equipment has since reached end of life and is no longer
supported by Cisco, the equipment manufacturer.
WHEREAS, the City is now required to upgrade this equipment with newer models
that will stay supported under manufacturer’s contract, and
WHEREAS, pursuant to City of Miami Gardens, Procurement Code Section 2-757,
the City may enter into competitively solicited contracts, and
WHEREAS, the State of Utah, Division of Purchasing, pursuant to solicitation and
a procurement process entered into Contract #AR3227 with Cisco Systems, Inc. herein
attached as Exhibit “A”, and
WHEREAS, the awarded contract currently expires on September 30, 2024, and
WHEREAS, Participating Agreement #43220000-NASPO-19-ACS, herein
attached as Exhibit “B,” was executed authorizing the State of Florida, Department of
Management Services to utilize Contract #AR3227 for data communications products and
services, and
WHEREAS, staff is requesting approval to enter into a two (2) year agreement with
an option to buy with vendor AIP US, LLC Inc., to lease Cisco Network Equipment for an
annual amount of Ninety Nine Thousand, Eight Hundred and Thirty Four Dollars and
Twenty Seven Cents ($99,834.27), subject to appropriation of funds, by relying on
Participating Agreement #43220000-NASPO-19-ACS, and

WHEREAS, the duration of the contract will extend a total of two years for an
amount not to exceed One Hundred Ninety Nine Thousand, Six Hundred and Sixty Eight
Dollars and Fifty Four Cents ($199,668.54) if funding is appropriated, with the option to
buy out for one dollar at the end of the agreement, and
WHEREAS, funding for the has been approved in the 2022 budget from Account
# 001-16-01-516-642-00, and
Whereas, City Staff recommends the City Council authorize the City Manager to
negotiate and execute that certain agreement with AIP US, LLC for the lease with an
option to buy of Cisco Network Equipment (detailed on quote #20211129) for an amount
not to exceed Ninety Nine Thousand, Eight Hundred and Thirty Four Dollars and Twenty
Seven Cents ($99,834.27) annually, for two years, by relying on Participating Agreement
#43220000-NASPO-19-ACS subject to appropriation of funding,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager to negotiate and execute that certain agreement with
AIP US, LLC for the lease of Cisco Network Equipment (detailed on quote #20211129)
for an amount not to exceed Ninety Nine Thousand, Eight Hundred and Thirty Four
Dollars and Twenty Seven Cents ($99,834.27) annually, for two years with an option to
buy, by relying on Participating Agreement #43220000-NASPO-19-ACS.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON APRIL 13, 2022.
