A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND
ATTEST, RESPECTIVELY, THAT CERTAIN INTERLOCAL
THE FOR COUNTY MIAMI-DADE WITH AGREEMENT
ESTABLISHMENT, CREATION, AND IMMEDIATE TRANSFER
OF THE VISTA LAGO MULTIPURPOSE MAINTENANCE
MIAMIOF CITY THE DISTRICT TAXING SPECIAL TO
GARDENS, A COPY OF WHICH IS ATTACHED HERETO AS
EXHIBIT “A”; PROVIDING FOR INSTRUCTIONS TO THE CITY
CLERK; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Vista Lago is a residential community close to the completion of
construction with a mix of townhomes, condominiums and apartments located at 502
NW 207th Street in Miami Gardens, and
WHEREAS, on October 14, 2020, the City Council approved Resolution #2020-
121-3519 to Community Lago Vista for to support the create the Multipurpose
Maintenance Special Taxing Districts pursuant to Chapter 18 of the Code of Miami-
Dade County, a copy of which is attached hereto as Exhibit “B”, and
WHEREAS, the Special Taxing District(s) would only apply to property owners
within the development in order to fund maintenance of common areas at the sole cost
of the owners, however, will remain dormant unless the Homeowner’s Association
(HOA) ceases to operate effectively, and
WHEREAS, the County is now requiring an interlocal agreement for the creation
and immediate transfer of the Vista Lago Multipurpose Maintenance Special Taxing
District to the City, and
WHEREAS, this would allow the City to takeover the Special Taxing District,
collect the funds through the tax roll, and be able to maintain the common areas if the
HOA ceases to operate/maintain it effectively, and
WHEREAS, City Staff recommends the City Council authorize the City Manager
to enter into an Interlocal Agreement with the County for the establishment, creation,
and the immediate transfer of the Vista Lago Multipurpose Maintenance Special Taxing
District to the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:

Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest,
respectively, that certain Interlocal Agreement with Miami-Dade County for the
establishment, creation, and immediate transfer of the Vista Lago Multipurpose
Maintenance Special Taxing District to the City of Miami Gardens, a copy of which is
attached hereto as Exhibit “A”.
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to Miami Dade County.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
