Staff Summary: On March 11, 2009, the City Council adopted a revised City Fee Manual. Since adoption of the amended fee manual, the commercial alteration/repairs/renovati on fee of .124 per $1 of construction value has been protested by Building Department customers stating the fees are not comparable with other Building Departments throughout Miami‐Dade County. The complaints prompted a comparative analysis of the City of Miami Gardens fees for commercial alteration/repair in relation to other Building Departments, namely, City of Miami, Miami‐Dade County, Village of Pinecrest, City of Hialeah, and City of Doral. Our analysis revealed the average fee for commercial alteration/repair is approximately 3% of construction value, ranging from a low of 1% to a high of 7%. The City fee, as adopted, is 12% of construction value, which has served as a deterrent to residents trying to obtain alteration permits. Given the current economic climate, staff is proposing a decrease in the City’s commercial alteration/repair fee to the industry average 3% of construction value. Staff is confident that a decrease in the fee amount will produce a higher rate of commercial alteration/repair permit application submittals resulting in increased revenues. In addition, the City Building Division fee manual does not have a standard provision for the cost of expired permits for work that has already commenced (Renewal‐Work Commenced) but did not receive an approved inspection within the stipulated timeframe of 180 days as set forth in the Florida Building Code. It is industry standard that the above‐mentioned permit fees are set in an amount that is half the cost of the original permit covering the same project. As such, it is staff’s recommendation that the fee for “Renewal Permit – Work Commenced” be formally set at fifty (50) percent of the original permit fee. Proposed Action: The City Manager recommends that the City Council adopt the attached amendment to the building fee schedule to align the City with the industry norm.
