Required: Yes No RFP/RFQ/Bid #: X N/A Sponsor Name Dr. Danny Crew, City Manager Department: Planning and Zoning Short Title: RESOLUTION NO. 2010‐ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO TAKE ALL STEPS NECESSARY TO VACATE THAT CERTAIN 30.0’ WIDE PORTION OF N.W. 159 STREET ON PROPERTY KNOWN AS FLORIDA MEMORIAL UNIVERSITY, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; Staff Summary: Background As a condition of the City’s Tentative Plat approval for the Florida Memorial University site, the city will be required to vacate a 30.0’ wide right‐of‐way referred to as “theoretical” N.W. 159 Street, which encumbers the property from N.W. 42 Avenue to N.W. 44 Court, as it will not be improved as a functional right‐of‐way to service any of the planned improvements on the property. Current Situation The applicant, Florida Memorial University, in order to comply with their Tentative Plat approval. is requesting the vacation of the right‐of‐way, which will revert the property to the University, as the property owner on either side of the 30.0’ wide dedicated right‐of‐way. ITEM 10-A) RESOLUTION Vacating a portion of NW 159th Street (Florida Memorial University) 1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 Analysis The vacation of the right‐of‐way is a condition of the Tentative Plat approval that must be complied with for the approval of the Final Plat. The vacation of the 30.0’ wide dedicated right‐of‐way does not affect any other property owner other than the University, and the University has obtained letters of no objections from FPL, WASA, and Florida Gas, which if necessary, will require the provision of easements on the final plat for any existing services that may encumber the dedicated right‐of‐way. Proposed Action: Staff recommends the adoption of the Resolution for the right‐of‐way vacation. Attachment: Exhibit “A” Sketch and description of the right‐of‐way to be vacated
