HomeMy WebLinkAbout2022-163-7874_-_Palmetto_Homes_Infill_Program_-_Pending_-_PdfRESOLUTION NO. 2022-163-7874 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS,FLORIDA, ALLOCATING FUNDS IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE (25%) PERCENT OF THE HARD COSTS RELATED TO THE DEVELOPMENT OF INFILL PROGRAM PROJECTS FOR PROPERTIES CONVEYED TO HOMESPALMETTO MIAMIBY-COUNTY DADE AND LOCATED WITHIN THE CITY OF MIAMI GARDENS; ANNEGOTIATE MANAGER TO THEAUTHORIZING CITY AGREEMENT FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on, or about, August 31, 2020, the Miami-Dade County Board of County Commissioners adopted Resolution No. R-821-20 authorizing the conveyance of eleven (11) county-owned properties to Palmetto Homes Urban Development Group, Inc. (“Palmetto Homes”), and WHEREAS, Palmetto Homes is a Florida not-for-profit corporation and an experienced developer of affordable housing through the Miami-Dade County Infill Housing Initiative Program (“Infill Housing Program”), and WHEREAS, the purpose of conveyance was to develop such properties with affordable housing to either be sold to very low-, low- to moderate-income households in accordance with the Infill Housing Program or rented to very low-, low- to moderate- income households in accordance with section 125.379, Florida Statutes, and the terms of Rental Regulatory Agreements, and WHEREAS, the properties will consist of single-family homes, townhomes, or multi-family structures comprised of three-bedroom and two-bedroom residential units to be rented or purchased, and WHEREAS, nine (9) of the designated properties conveyed to Palmetto Homes are located within the City of Miami Gardens, and WHEREAS, on February 23, 2022, the City Council authorized the City Attorney and City Manager, via Resolution No. 2022-020-3733, to resolve all issues related to City of Miami Gardens v. J.P. Morgan Chase & Co. et al, Case No. 1:14-Cv-22206-kmw, and WHEREAS, the Resolution also authorized the City Manager to make a portion of the funds available, on a reimbursement basis, for the construction of housing units built through the County’s Infill Housing Program, and WHEREAS, Vice Mayor Reggie Leon recommends that the City Council allocate funds in an amount not to exceed twenty-five (25%) of the hard costs related to the Resolution No. 2022-163-7874 DocuSign Envelope ID: 3CD462A9-79D2-48F9-95A0-E8E081E239EB development of Infill Housing Program projects for properties conveyed to Palmetto Homes and located within the City of Miami Gardens and, further, authorize the City Manager to negotiate an agreement for this purpose, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby allocates funds in an amount not to exceed twenty-five (25%) of the hard costs related to the development of Infill Program projects for properties conveyed to Palmetto Homes and located within the City of Miami Gardens. Further, the City Council of the City of Miami Gardens hereby authorizes the City Manager to negotiate an agreement for this purpose. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
