HomeMy WebLinkAbout2022-130-3841_-_Implementing_Procedure_for_Redistricting_-_Adopted_-_PdfRESOLUTION NO. 2022-130-3841 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, IMPLEMENTING PROCESSES AND PROCEDURES FOR DISTRICT BOUNDARY CHANGES IN ACCORDANCE WITH SECTION 2.3(C) OF THE CITY OF MIAMI GARDENS CHARTER; PROVIDING FOR PROCEDURES; PROVIDING FOR AUTHORITY TO THE CITY CLERK; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPLEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, in accordance with the City of Miami Gardens Charter, the City Council consists of a Mayor and two At-Large Council Members elected citywide along with four Council Members to be elected from single-member districts, the Charter also sets the boundaries for each residential district, and WHEREAS, the City should ensure that there is as close to equal representation as possible in each residential district, and WHEREAS, the City Clerk previously provided information to the City Council indicating that based on the 2020 Census, the City of Miami Gardens population has increased by 5.2% percent from 105,800 (2010) to 111,640 (2020), and registered voters has increased by 10.9% from 62,219 (2010) to 69,908 (2021), and WHEREAS, on August 23, 2022, the voters in Miami Gardens voted to amend section 2.3(c) of the City Charter to include a provision authorizing the amendment of residential seat area boundaries by Ordinance from time to time to ensure equitable representation in each district, and WHEREAS, it is appropriate that procedures be implemented to determine when to move forward with undertaking the appropriate studies and retaining the appropriate experts to recommend an Ordinance to the City Council to amend the district boundaries, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: SECTION 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas Clauses are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. SECTION 2. DIRECTIONS TO THE CITY CLERK: The process for amending residential boundaries in accordance with Section 2.3(c) is outlined below: Resolution No. 2022-130-3841 DocuSign Envelope ID: DEA17964-DAB1-4984-BAC2-40882B7EC790 1. Whenever the registered voters in one or more residential district is uneven by a margin greater than 10%, the City Clerk shall inform the City Council and the City Council shall determine whether to engage the appropriate experts to undertake the appropriate studies and to make recommendations for an ordinance to amend the residential district boundaries. 2. The City Clerk shall be required to review the number of registered voters in the residential districts, after each citywide election and after each decennial census, and shall inform the City Council of his/her findings. In the event, one or more residential district is uneven by a margin greater than 10%, the City Council shall determine whether to engage the appropriate experts to undertake the appropriate studies and make recommendations for an ordinance to amend the residential district boundaries. SECTION 3: EFFECTIVE DATE: This Resolution shall become immediately effective upon its passage.
