HomeMy WebLinkAbout2023-003-459_-_Purchase_Sales_Contract_-_Property_Address_15880_NW_27_Avenue,_Miami_Gardens_Florida_ORDINANCE NO. 2023-003-459 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE THAT VACANT LAND SALE AGREEMENT AND ALL ATTENDANT DOCUMENTS WITH LEGACY DEVELOPMENT ALLIANCE, LLC, ATTACHED HERETO AS EXHIBIT “A” FOR THE SALE OF THAT REAL PROPERTY LOCATED AT 15880 NW 27TH AVENUE FOR FIVE HUNDRED AND TWENTY THOUSAND DOLLARS ($520,000.00); PROVIDING FOR INSTRUCTIONS TO THE CITY MANAGER; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council, in Resolution 2022-014-3727, authorized the City Manager to negotiate a sales contract with Legacy Development Alliance, LLC for the sale of that real property located at 15880 NW 27TH Avenue, Miami Gardens, and WHEREAS, an agreement has been reached and the City Manager is recommending the City Council approve the Vacant Land Sale Agreement and authorize the City Manager to execute the same, and WHEREAS, in accordance with the negotiated Sale Agreement, the property will be purchased at a price of $520,000.00 and the buyer will pay cash for the property with no financing contingency, and WHEREAS, Buyer agrees that the property shall be used in compliance with the current deed restrictions recorded in Official Records Book 30654, Page 882 of the public records of Miami Dade County, Florida and will be developed and operated as a full service sit down restaurant, and WHEREAS, in accordance with Section 4.3(7) of the City of Miami Gardens Charter, an ordinance is required to convey any lands of the City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance. Section 2. AUTHORIZATION: The City Council hereby authorizes the City Manager to finalize and execute that certain Vacant Land Sale Agreement and all DocuSign Envelope ID: 19735382-E819-4065-AFF1-0D7930FC52D9 Page 2 of 3 Ordinance 2023-003-459 attendant documents attached hereto as Exhibit “A” for sale of the property located at 15880 NW 27TH Avenue, Miami Gardens. Section 3. CONFLICT: All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. INCLUSION IN CODE: It is the intention of the City Council of the City of Miami Gardens that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Miami Gardens and that the section of this Ordinance may be renumbered or relettered and the word “Ordinance” may be changed to “Chapter,” “Section,” “Article” or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed. Section 6. EFFECTIVE DATE: This Ordinance shall become effective immediately upon its final passage. PASSED ON FIRST READING ON THE 14th DAY OF DECEMBER, 2022.
