HomeMy WebLinkAbout2023-034-1924_-_Streetlight_Improvement_Agreement_-_Adopted.docxRESOLUTION NO. 2023-034-1924 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS THE GOVERNING BODY OF THE SPECIAL TAXING DISTRICTS LISTED ON EXHIBIT “A,” ATTACHED HERETO, AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH FLORIDA POWER & LIGHT (FPL) FOR STREETLIGHT UPGRADES, PER DISTRICT, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED SEVENTY-THREE THOUSAND FOUR HUNDRED FORTY-TWO DOLLARS AND EIGHTY-TWO CENTS ($173,442.82) PLUS MAINTENANCE COSTS ASSOCIATED WITH EACH UPGRADE, RESPECTIVELY; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 18-3.1 of the Miami-Dade County Code provides, for a special taxing district located entirely within municipal boundaries, the County may designate the governing body of the municipality as the governing body of the special taxing district, subject to a majority vote of the qualified electors residing in the district, and WHEREAS, on May 1, 2018, Miami-Dade County (County) adopted Resolution Number: (1) R-438-18 (Andover 1st Addition), (2) R-434-18 (Bunche Park South), (3) R- 434-18 (Bunche Park), (4) R-404-18 (Crestview), (5) R-412-18 (Lake Lucern), (6) R-436- 18 (Liberty Homes), (7) R-432-18 (Miami Gardens), (8) R-426-18 (North Dade Country Club Village), (9) R-442-18(Peachtree Lane), (10) R-402-18 (Riverdale), (11) R-430-18 (Rolling Oaks), (12) R-422-18 (Scott Lake Manor East), (13) R-416-18 (Scott Lake Manor), (14) R-420-18 (Stoneybrook), (15) R-410-18 (Venetian), (16) R-406-18 (Andover), which called a special election for the Special Taxing District, and WHEREAS, in December 2018, the electors within the Special Taxing Districts approved the transfer of the Special Taxing Districts to the City of Miami Gardens (City), and WHEREAS, the City adopted Resolution Number: (1) 2019-051-3680 (Andover 1st Addition), (2) 2019-052-3681 (Bunche Park South), (3) 2019-053-3682 (Bunche Park), (4) 2019-054-3683 (Crestview), (5) 2019-057-3686 (Lake Lucern), (6) 2019-058-3687 (Liberty Homes), (7) 2019-059-3688 (Miami Gardens), (8) 2019-060-3689 (North Dade Country Club), (9) 2019-061-3690 (Peachtree Lane), (10) 2019-062-3691 (Riverdale), (11) 2019-063-3692 (Rolling Oaks), (12) 2019-064-3693 (Scott Lake Manor East), (13) 2019-065-3694 (Scott Lake Manor), (14) 2019-066-3695 (Stoneybrook), (15) 2019-067- 3696 (Venetian Acres), and (16) 2019-069-3698 (Andover) accepting the transfer of control from the County to the City of Street Lighting Improvements Special Taxing Districts located entirely within the City, WHEREAS, Florida Power & Light (FPL) owns the light poles and light fixtures throughout the City-owned streets and they must retro-fitted all the existing lighting to DocuSign Envelope ID: 05D2E4BF-D4B3-4450-AEAB-4F858800D1F0 Page 2 of 3 Resolution NO. 2023-034-1924 LED fixtures and lamps to address inefficient lighting and achieve high levels of “post- retrofit” light coverage, and WHEREAS, the City engaged an engineering consultant to perform a comprehensive streetlighting study (1) that provided a detailed report of lighting deficiencies and necessary lighting improvements per district, (2) identified pole placement in each area including fixtures and bracket sizes, and (3) provided any additional information, and WHEREAS, all three streetlight studies were completed and provided all the information/details needed to support continuous lighting to illuminate all stretches of roadway between intersections in the City, and WHEREAS, the Illumination Project is now ready for construction with an estimated cost of One Hundred Fifty-Seven Thousand Six Hundred Seventy-Five Dollars and Twenty-Nine Cents ($157,675.29) with a contingency amount of ten percent (10%) for a grand total of One Hundred Seventy-Three Thousand Four Hundred Forty-Two Dollars and Eighty-Two Cents ($173,442.82), and WHEREAS, funding for this streetlight retro-fit expense is available in account #100-41-05-541-630-00 and the maintenance amount will be distributed in the different Streetlight Special Taxing District Accounts, and WHEREAS, the City Manager requests that the City Council authorize him to execute an Agreement with Florida Power & Light (FPL) for streetlight upgrades, per district, in an amount not to exceed One Hundred Seventy-Three Thousand Four Hundred Forty-Two Dollars and Eighty-Two Cents ($173,442.82) plus maintenance cost associated with each upgrade, respectively, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens, as the governing body of the Special Taxing Districts listed on Exhibit “A,” attached hereto, hereby authorizes the City Manager to execute Agreements with Florida Power & Light (FPL) for streetlight upgrades, per district, in an amount not to exceed One Hundred Seventy-Three Thousand Four Hundred Forty-Two Dollars and Eighty-Two Cents ($173,442.82) plus maintenance costs associated with each upgrade, respectively. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
