HomeMy WebLinkAbout2023-059-1949_-_Local_Agency_Program_Agreement_for_Trail_at_BTF_-_Adopted.docxRESOLUTION NO. 2023-059-1949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, ACCEPTING ONE MILLION DOLLARS ($1,000,000.00) FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF A TRAIL LOCATED AT NW 191ST STREET TO THE BETTY T. FERGUSON RECREATIONAL COMPLEX; AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, THAT CERTAIN LOCAL AGENCY CERTIFICATION QUALIFICATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in May 2013, the Planning and Zoning Department and the Public Works Department submitted an application to the Metropolitan Planning Organization to be eligible to receive grant funding under the Transportation Alternative Program (TAP), and WHEREAS, the TAP is an element of the Federal Highway Administration’s Surface Transportation Program that provides funds for the development of “non- traditional” transportation projects and a Local Agency Program agreement is required for each transportation project the City receives federal financial assistance under the Florida Department of Transportation (FDOT), and WHEREAS, this trail project was approved under the FDOT #FM 435505-1-58-01 - NW 191st St/Betty Ferguson Recreation Complex and the new trail, a description of which is attached hereto as Exhibit B, connects NW 191 Street-Risco Park to the Betty T. Ferguson Community Center, and WHEREAS, the City has expended funds under the Citizens’ Independent Transportation Trust (CITT) to complete the design of One Hundred Ninety-Nine Thousand Seven Hundred Forty Dollars ($199,740.00), and will be expending additional funds for the Construction Engineering Inspection Services (CEI) and any permit fees, and WHEREAS, the FDOT funding is strictly for construction and a total of One Million Dollars ($1,000,000.00) has been awarded to complete the new trail, and WHEREAS, sufficient funding for this project is available in the CITT account 100- 41-05-541-630-00, and WHEREAS, City Staff recommends that the City Council accept One Million Dollars ($1,000,000.00) from the Florida Department of Transportation for the construction of a trail located at NW 191st Street to the Betty T. Ferguson Recreational DocuSign Envelope ID: B7087861-9CB0-47DA-81B5-10E57983D2DF Page 2 of 3 Resolution No. 2023-059-1949 Complex and authorize the City Manager and the City Clerk to execute and attest, respectively, that certain Local Agency Certification Qualification Agreement with the Florida Department of Transportation, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby accepts One Million Dollars ($1,000,000.00) from the Florida Department of Transportation for the construction of a trail located at NW 191st Street to the Betty T. Ferguson Recreational Complex. Further, the City Council of the City of Miami Gardens hereby, authorizes the City Manager and the City Clerk to execute and attest, respectively, that certain Local Agency Certification Qualification Agreement with the Florida Department of Transportation. Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby authorized to obtain two (2) fully executed copies of the subject Agreement with one to be maintained by the City, and one to be delivered to the Florida Department of Transportation. Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
