A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO TAKE ALL STEPS
NECESSARY TO VACATE AND ABANDON THE WATER TANK
EASEMENT LOCATED AT SCOTT PARK, FOLIO 34-2111-007-
1250; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Miami Gardens authorized the issuance
of General Obligation Bonds to pay the costs of various improvements to the City’s parks
and also adopted a Bond Implementation Plan that listed improvements to be
incorporated into each park project, and
WHEREAS, included in the adopted Bond Implementation Plan is the renovation
of Scott Park, and
WHEREAS, there is an approximately 390'-0" by 400'-0" easement located in folio
34-2111-007-1250 for a water tank dated to North Dade Water Co. recorded in 1957, a
copy of which is attached hereto as Exhibit A and B, respectively, and
WHEREAS, City Staff recommends that the City Council authorize the vacation
and abandonment of this easement to continue construction of the new park building and
site improvements,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and City Attorney to take all steps necessary to
vacate and abandon the water tank easement located at Scott Park, Folio 34-2111-007-
1250.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON JUNE 28, 2023.
