A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY, THAT CERTAIN OFF-SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR
WORK IN THE CITY’S RIGHT-OF-WAY AS PART OF THE NW
183RD STREET IMPROVEMENT PROJECT (FM# 447800-1-52-
01); PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Off-System Construction and Maintenance Agreement
(“Agreement”) allows the Florida Department of Transportation (“FDOT”) to accomplish
their road improvements on some of the areas that overlap into the City’s Right of Way
with their project (FM# 447800-1-52-01, SR 860/Miami Gardens Drive/NW183rd Street -
from west of NW 27th Avenue to west of NW 2nd Avenue), and
WHEREAS, the City right-of-way roads that are affected are as follows:
1. NW 24th Avenue,
2. NW 23rd Avenue,
3. NW 20th Avenue,
4. NW 19th Avenue,
5. NW 18th Avenue,
6. NW 17th Avenue,
7. NW 14th Avenue,
8. NW 12th Avenue,
9. NW 10th Court,
10. NW 9th Avenue,
11. NW 7th Avenue,
12. NW 6th Court,
13. NW 6th Avenue,
14. NW 5th Court,
15. NW 5th Avenue,
16. NW 3rd Avenue,
17. NW 2nd Court, and
18. Along the North and South Frontage Road, a road not on the State Highway
System.
WHEREAS, the City’s right-of-way are, and will remain, under the ownership of the
City and the City will maintain its portion of improvements completed, and
WHEREAS, this project will be completed at the expense of FDOT, and

WHEREAS, City Staff recommends that the City Council authorize the City
Manager and the City Clerk to execute and attest, respectively, that certain Off-System
Construction and Maintenance Agreement with the Florida Department of Transportation
for work in the City’s right-of-way as part of the NW 183rd Street Improvement Project
(FM# 447800-1-52-01),
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest, respectively,
that certain Off-System Construction and Maintenance Agreement with the Florida
Department of Transportation for work in the City’s right-of-way as part of the NW 183rd
Street Improvement Project (FM# 447800-1-52-01) .
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to the Florida Department of
Transportation.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON JUNE 28, 2023.
