BROWN, AS THE LEGAL ADVISOR TO THE NUISANCE ABATEMENT BOARD; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE Staff Summary: The City of Miami Gardens has established a Nuisance Abatement Board, the purpose of which is to promote, protect, and improve the health, safety and welfare of the citizens of the City of Miami Gardens by reducing the use of property within the City for the unlawful sale, delivery of possession of controlled substances, prostitution, youth and street gang activity, gambling, illegal sale, possession or consumption of alcoholic beverages, lewd or lascivious behavior or other criminal activity. Nuisance Abatement Board members will be required to determine whether the provisions of the City’s Ordinance and Florida Statutes have been violated. The City’s Attorney’s Office will be responsible for prosecution of the Nuisance Abatement Board cases and as such, and in accordance with Rules of Ethics, the City Attorney’s Office should not be also advising the Nuisance Abatement Board. In accordance with the Nuisance Abatement Board Ordinance previously adopted by the City Council, the City Attorney is to recommend an attorney who is to advise the Nuisance Abatement Board. The City Attorney is recommending Vincent T. Brown to serve as the Nuisance Abatement Board Advisor. Mr. Brown previously served as an advisor to the Nuisance Abatement Board for Miami‐Dade County. ITEM J-1) CONSENT AGENDA RESOLUTION Appointing the Legal Advisor to the Nusance Abatement Board 1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 The City Attorney’s Office will negotiate an agreement with Vincent T. Brown to provide services to the Nuisance Abatement Board. It is expected that Mr. Brown will be paid an hourly rate of $200.00 for services provided to the Nuisance Abatement Board. Mr. Brown’s resume is attached as Exhibit “A.” Proposed Action: The City Attorney recommends Council’s approval of the recommendation of Vincent T. Brown to serve as the Nuisance Abatement Board advisor for a period of one (1) year from the first meeting of the Board. Attachment: Exhibit “A” – Vincent T. Brown’s resume.
