A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, WAIVING THE DISTANCE
REQUIREMENTS FOR THE SALE OF ALCOHOLIC
BEVERAGES AS SET FORTH IN SECTION 34-147 OF THE CITY
OF MIAMI GARDENS CODE OF ORDINANCES FOR THAT
CERTAIN PROPERTY LOCATED AT 18581-18583 NW 27TH
AVENUE, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A”
ATTACHED HERETO; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the subject bay is located within the Miami Gardens Plaza commercial
shopping center at 18581-18583 NW 27th Avenue, zoned for Entertainment Overlay, and
is designated as “Commerce” within the City of Miami Gardens Comprehensive
Development Master Plan, and
WHEREAS, Miami Legendz Sports Café (“Legendz”) seeks to operate a family-
friendly establishment that includes the serving of alcoholic beverages, however, its
proximity to schools, churches, and residential areas of the City prohibits its use, and
WHEREAS, a waiver of the distance requirements for alcoholic beverage sales as
outlined in Section 34-147 of the City's Code of Ordinances is required in order for the
establishment to begin operations at the subject location, and
WHEREAS, currently, Legendz is proposed to be located 1,700 feet from Miami
Gardens Church of Christ, 75 feet from Kids Haven Academy, and 345 feet from Pelican
Cove Apartments and a waiver of these distances would exceed the 25% threshold for
staff approval, and
WHEREAS, the City Council has considered the testimony of the Applicant, if any,
and the Staff Report attached hereto as Exhibit “B” and incorporated by reference, and
WHEREAS, City Staff recommends that the City Council waive the distance
requirements for the sale of alcoholic beverages as set forth in section 34-147 of the City
of Miami Gardens Code of Ordinances for that certain property located at 18581-18583
NW 27th Avenue, more particularly described in Exhibit “A” attached hereto,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby waives the distance requirements for the sale of alcoholic beverages as set forth
in section 34-147 of the City of Miami Gardens Code of Ordinances for that certain
property located at 18581-18583 NW 27th Avenue, more particularly described in Exhibit
“A” attached hereto.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON SEPTEMBER 13, 2023.
