A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, AUTHORIZING THE CITY MANAGER AND
CITY ATTORNEY TO TAKE ANY AND ALL STEPS NECESSARY
TO ACCEPT THE CONVEYANCE OF THE RIGHTS-OF-WAY
LOCATED IN THE LESLIE ESTATES COMMUNITY #1 & #2
UNDER LESLIE ESTATES HOMEOWNERS ASSOCIATION #1,
MORE PARTICULARLY DESCRIBED ON EXHIBIT “A”
ATTACHED HERETO; PROVIDING FOR THE ADOPTION OF
REPRESENTATION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, since the incorporation of the City, the City has received many
complaints from the Leslie Estates Communities about the infra-structure (roads and
drainage) being dilapidated and many potholes starting to appear on the roads due to the
fact that no maintenance has been done since the roads were built, and
WHEREAS, in order for the City to complete the needed infrastructure
improvements in the Leslie Estates neighborhood, it is necessary to have the Right-Of-
Ways transferred from the Leslie Estates #1 Homeowners Association, Inc., and
WHEREAS, on March 16, 2023, the Board of Directors of the Leslie Estates #1
Homeowners Association, Inc. (Leslie Estates #1 and #2), passed a resolution to convey
to the City of Miami Gardens the Right-Of-Ways to the neighborhood’s paved streets and
cul-de-sacs as detailed in the attached surveys, and
WHEREAS, a resolution is needed in order for the City to accept the road
conveyance, and
WHEREAS, upon completion to the transfer, the next step is to design the project
and start the bid process to go into construction, and
WHEREAS, funding for this project cost of $1.2 million will come from account #
401-41-09-538-630-00 – Stormwater Funds and 100-41-05-541-630-00 – CITT Funds,
and
WHEREAS, Staff recommends that the City Council approve the acceptance of
the Right- of- Ways within the Leslie Estates Community #1 and #2 as described in the
attached surveys,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and City Attorney to take any and all steps necessary
to accept the conveyance of the Right- of- Ways located in the Leslie Estates Community
#1 & #2 under Leslie Estates Homeowners Association #1
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
