HomeMy WebLinkAbout2023-162-2052_-_Second_Amendment_of_Restrictive_Covenant_for_Miami_Gardens_City_Center_(35_Acres)_-_RESOLUTION NO. 2023-162-2052 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING A SECOND AMENDMENT TO DECLARATION OF COVENANTS AND RESTRICTION FOR PROPERTY LOCATED AT 19199 NW 27TH AVENUE MORE PARTICULARLY DESCRIBED ON EXHIBIT “A” ATTACHED HERETO, TO FACILITATE THE DEVELOPMENT OF THE MIAMI GARDENS CITY CENTER; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Miami Gardens Town Center LLC is the owner of approximately 35 acres of land located at 19199 NW 27th Avenue as shown in Exhibit “A”, and WHEREAS, the property is slated for a mixed-use development project to include residential, retail, restaurants, hotels, and a variety of entertainment uses, and WHEREAS, as shown in Exhibit “C”, the owner entered into a Declaration of Restrictive Covenants with the City as recorded in the official records on March 4, 2020, and WHEREAS, the owner committed to developing the site in a manner consistent with the conceptual site plan attached therein, and WHEREAS, on June 24, 2022 a First Amendment was made to the declaration deleting and replacing the legal description in the original covenant, along with nullifying the exhibit containing the conceptual site plan, and WHEREAS, per the revised covenant, the owner was required to replace the conceptual site plan through a Second Amendment, and WHEREAS, the development is currently in the site plan and permitting phase and is poised to start construction in short order, and WHEREAS, based on the language of the First Amendment, the owner is now obligated to bring forward a Second Amendment for approval to replace the original Conceptual Site Plan Exhibit, and WHEREAS, the new Conceptual Plan is attached as Exhibit “B” of the proposed Second Amendment, and WHEREAS, Staff recommends that the City Council approve the Second Amendment to the Declaration of Restrictions to facilitate the development of the Miami Gardens City Center, DocuSign Envelope ID: 5F2FF97B-5701-47E8-B8F9-A1FAF862FA7D Page 2 of 2 Resolution No. 2023-162-2052 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves a Second Amendment to Declaration of Covenants and Restriction for property located at 19199 NW 27th Avenue more particularly described on Exhibit “A” attached hereto, to facilitate the development of The Miami Gardens City Center. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
