A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY, THAT CERTAIN INTERLOCAL AGREEMENT
WITH BROWARD COUNTY FOR AIRPORT ZONING
REGULATIONS; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the North Perry Airport is located in Broward County (“County”)
approximately 3.5 miles north of the City of Miami Gardens (“City”) and a portion of the
Airport's hazard area, as defined in Section 333.01(4) of Florida Statutes, is located within
the City limits, and
WHEREAS, the City and County are required by Section 333.03(1)(b) to either: (i)
enter into an interlocal agreement to adopt, administer, and enforce the airport zoning
regulations; or (ii) adopt an ordinance, regulation, or resolution creating a joint airport
zoning board that shall adopt, administer, and enforce a set of airport zoning regulations,
and
WHEREAS, the City and County have proposed an interlocal agreement, attached
hereto as Exhibit “A”, in order to comply with Florida Law, and
WHEREAS, City Staff recommends that the City Council authorize the City
Manager and City Clerk to execute and attest, respectively, that certain Interlocal
Agreement with Broward County for Airport Zoning Regulations,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and City Clerk to execute and attest, respectively,
that certain Interlocal Agreement with Broward County for Airport Zoning Regulations.
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to Broward County, as a political
subdivision of the State of Florida.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
