HomeMy WebLinkAbout2023-180-2070_-_Cybersecurity_Framework_-_Adopted.docxRESOLUTION NO. 2023-180-2070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, ADOPTING THE NATIONAL INSTITUTE OF TECHNOLOGY AND STANDARDS CYBERSECURITY FRAMEWORK AS REQUIRED BY FLORIDA STATUTE 282.3185 ENACTED IN 2022; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in 2022 the Florida Legislature passed the Florida Statute 282.3185 also referred to as the Local Government Cyber Security Act, and WHEREAS, under the statute each local government is required to adopt cybersecurity standards that safeguard its data, information technology, and information technology resources to ensure availability, confidentiality and integrity, and WHEREAS, the cybersecurity standards must be consistent with generally accepted best practices for cybersecurity, including the National Institute of Standards and Technology Cybersecurity Framework, and WHEREAS, municipalities with a population of over 25,000 must adopt the cybersecurity standards required by January 1, 2024, and WHEREAS, in order to comply with Florida Statutes, City Staff recommends that the City Council adopt the National Institute of Technology and Standards Cybersecurity Framework, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby adopts the National Institute of Technology and Standards Cybersecurity Framework as required by Florida Statute 282.3185 enacted in 2022. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
