HomeMy WebLinkAbout2024-032-2105_-_Urging_MDC_County_to_Transfer_Water_-_Adopted.docxRESOLUTION NO. 2024-032-2105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, URGING THE MIAMI-DADE BOARD OF COUNTY COMMISSIONERS TO DEVELOP A PROCESS TO TRANSFER THE WATER OF CITY RATE PAYERS WHO ARE CURRENTLY RECEIVING WATER FROM NORTH MIAMI BEACH TO MIAMI-DADE COUNTY; PROVIDING FOR INSTRUCTIONS TO THE CITY MANAGER AND CITY ATTORNEY; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, water customers in the City of Miami Gardens receive water service from either the City of North Miami Beach, Miami-Dade County or the City of Opa-Locka, and WHEREAS, rate payers who receive their water from North Miami Beach pay considerably more for water than those rate payers who receive water from Miami-Dade County or Opa-Locka, and WHEREAS, part of the reason that the rates from North Miami Beach are higher is due to the fact that North Miami Beach charges an additional 25% to City of Miami Gardens rate payers, and WHEREAS, it is of note that when the City of Miami Gardens incorporated in 2003, North Miami Beach raised the surcharge from 15% to 25%, and WHEREAS, since the inception of the City of Miami Gardens, the City has urged the City of North Miami Beach to lower the water rates for City of Miami Gardens rate payers and specifically has requested that the 25% surcharge on Miami Gardens rate payers be reduced, and WHEREAS, the City of Miami Gardens initiated litigation challenging the City of North Miami Beach’s right to charge the surcharge, and WHEREAS, despite requesting that the City of North Miami Beach reduce the surcharge, it has refused to do so, even though the only water plant that the City of North Miami Beach has is located in the City of Miami Gardens and even though the aquifers are located in the City of Miami Gardens, and WHEREAS, Councilwoman Linda Julien is sponsoring this resolution to request that Miami-Dade County begin the process of assisting the City of Miami Gardens with transferring those rate payers in the City of Miami Gardens who currently receive water from North Miami Beach to Miami Dade County so that those rate payers can receive water at a rate that is comparable to the water rates of Miami-Dade County and/or the City of Opa-Locka, DocuSign Envelope ID: D310E0F1-929B-42FE-A6C6-634FFB5DA5E7 Page 2 of 2 Resolution No. 2024-032-2105 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby urges the Miami-Dade Board of County Commissioners to develop a process to transfer the water of city rate payers who are currently receiving water from North Miami Beach to Miami-Dade County. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
