A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, RATIFYING INVITATION TO BID
NO. 22-23-018, SUPPLY AND DELIVERY OF PRE-FILLED
SANDBAGS, TO ESR, LLC., AUTHORIZING THE CITY
MANAGER TO EXECUTE THAT CERTAIN ADDENDUM WITH
ESR, LLC ATTACHED HERETO AS EXHIBIT “A”; PROVIDING
FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Invitation to Bid (ITB) No. 22-23-018 Supply and Delivery of Pre-Filled
Sandbags was advertised via BidSync on April 11, 2023 and closed on May 16, 2023 two
bids were received from ESR, LLC., and Latam Xport/STYME, and
WHEREAS, the Office of Procurement Management staff reviewed submitted bid
and publicly posted the results on Bidscync, and
WHEREAS, after bid review ESR, LLC., was determined to be the most responsive
firm and the results were publicly posted on Bidsync for the required seventy-two (72)
hours, no objections were received, and
WHEREAS, the term of the initial period of the agreement is two (2) years and the
City reserves the right to exercise the option to renew annually (subject to the
appropriation of funds), not to exceed a maximum of three (3) one (1) year periods, and
WHEREAS, a copy of the ITB document and submittals are available for review
upon request, and
WHEREAS, the Addendum attached as Exhibit “A, ”authorizes other governmental
agencies to rely on the rates outlined in the ITB during the term of the Agreement and
any renewals, and
WHEREAS, it is recommended that the City Council ratify the award of ITB Number
22-23-018, Supply and Delivery of Pre-Filled Sandbags to ESR., LLC and authorize the
City Manager to execute the attached Addendum, renewal and related documents,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby ratifies Invitation to Bid No. 22-23-018, Supply and Delivery of Pre-Filled

Sandbags, to ESR, LLC. The City further authorizes the City Manager to execute that
certain Addendum with ESR, LLC attached hereto as Exhibit “A”.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

AT ITS REGULAR MEETING HELD ON MARCH 27, 2024.
