A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY THAT CERTAIN MEMORANDUM OF
UNDERSTANDING WITH THE FLORIDA DEPARTMENT OF
TRANSPORTATION (FDOT) FOR MEDIAN LANDSCAPING AND
IRRIGATION IMPROVEMENTS, A COPY OF WHICH IS
ATTACHED HERETO AS EXHIBIT “A”; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on December 11, 2014, the City Council authorized staff to enter into
the Landscape Maintenance Joint Participation Agreement with the Florida Department
of Transportation (FDOT) to provide landscaping maintenance services on NW 27
Avenue, NW 183 Street and NW 2 Avenue (441), a copy of which is attached hereto as
Exhibit B, and
WHEREAS, the proposed Memorandum of Understanding (MOU), a copy of which
is attached hereto as Exhibit A, is to incorporate FDOT’s re-surfacing project on NW 27
Avenue that includes landscaping and irrigation improvements to the original
Maintenance Memorandum of Agreement (MMOA) that was passed on December 11,
2014, and
WHEREAS, this MOU will allow FDOT to complete the landscaping and irrigation
improvements on NW 27 Avenue that the City will continue to maintain into the future and
this project will be completed at the expense of FDOT with no City Funds, and
WHEREAS, City Staff recommends that the City Council authorize the City
Manager to execute that certain Memorandum of Understanding with FDOT for Median
Landscaping and Irrigation Improvements, a copy of which is attached hereto as Exhibit
“A”,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and the City Clerk to execute and attest, respectively,
that certain Memorandum of Understanding with the Florida Department of Transportation
(FDOT) for Median Landscaping and Irrigation Improvements, a copy of which is attached
hereto as Exhibit “A”.

Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to Florida Department of
Transportation.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

AT ITS REGULAR MEETING HELD ON APRIL 10, 2024.
