Crew, City Manager Department:Public Works / Stormwater  Short  Title: A  RESOLUTION  OF  THE  CITY  COUNCIL  OF  THE  CITY  OF  MIAMI  GARDENS, FLORIDA  AMENDING  A  BID  TO  QUALITY  PAVING, INC., IN  THE  AMOUNT  OF  FIFTY ‐SIX  THOUSAND, SIX  HUNDRED  TWENTY ‐FOUR  DOLLARS  AND  76/100  ($56,624.76),  FOR  CONSTRUCTION  REVISIONS  OF  THE  NW  191   STREET  STORMWATER  DRAINAGE  PROJECT; AUTHORIZING  THE  CITY  MANAGER  AND  CITY  CLERK  TO  INCREAS E  AND  ATTEST  RESPECTIVELY, THAT  CERTAIN  AGREEMENT  WITH  QUALITY  PAVING, INC., A  COPY  OF  WHICH  IS  ATTACHED  HERETO  AS  EXHIBIT  “A”; PROVIDING  FOR  THE  ADOPTION  OF  REPRESENTATIONS; PROVIDING  AN  EFFECTIVE  DATE  Staff  Summary:  Background :  In  mid  2010, the  South  Florida  Water  Management  District  (SFWMD) informed  the  City  of  available  funding  for  stormwater  projects. The  City  applied  and  submitted  three  drainage  projects  from  the  City’s  ITEM K-3) CONSENT AGENDA RESOLUTION 191 Street Drainage Project   1515  NW  167  Street, Building  5  Suite  200    Miami  Gardens, Florida  33169   Stormwater  Master  Plan  and  other  flooding  areas  reported  by  residents. Each  stormwater  drainage  project  will  consist  of  design, permitting, and  construction  of  French  drains  with  catch  basins.   Specifically, the  SFWMD  has  funded  the  drainage  project  for  the  area  on  NW  191  and  193  Street  between  NW  9  Avenue  and  11  Place. Funding  provided  from  SFWMD  is  $162,500.  The  City  has  committed  an  additional  $211,000  from  the  Stormwater  Fund  per  the  original  agreement  with  SFWMD.  Council  awarded  the  bid  to  Quality  Paving, Incorporated  to  perform  the  work.  The  vendor  certifies  that  they  will  attempt  in  good  faith  to  hire  one  unemployed  resident  of  the  City  of  Miami  Gardens  for  this  project.   Current  Situation :  Prior  to  construction  and  the  start  of  the  design, the  City’s  design  consultant  (Chen  Moore  and  Associates) sent  a  letter  dated  March  5, 2011, to  North  Miami  Beach  requesting  utility  locations. The  information  was  received  by  the  consultant  and  the  project  was  design  accordingly.  After  the  design, the  project  was  approved  by  Permitting, Environment  and  Regulatory  Affairs  (PERA) on  August  21, 2011  and  North  Miami  Beach  received  a  copy  of  the  plans  at  the  pre ‐construction  meeting  on  April  2, 2012. The  contractor  was  given  the  notice  to  proceed  to  start  on  April  30, 2012.  At  the  time  the  project  was  75% completed  North  Miami  Beach  alerted  the  City  to  stop  the  project  because  there  was  a  nearby  Groundwater  Production  Well. North  Miami  Beach  also  alerted  PERA  which  issued  the  City  a  Cease  and  Desist  order  to  stop  the  project. The  City  understands  the  conflicts  of  the  project  with  the  nearby  well; however  this  conflict  was  not  flagged  during  the  PERA  project  environmental  approval  process. According  to  North  Miami  Beach, they  give  all  related  information  to  PERA  to  regulate  through  their  approval  process.  On  May  29, 2012, the  City  met  with  PERA  to  discuss  possible  solutions  to  this  issue. Their  position  was  for  the  City  to  remove  the  drainage  structures  and  piping  out  of  the  ground; however, this  would  be  a  waste  of  funds  for  the  City  and  South  Florida  Water  Management  District. Meanwhile, the  City  has  worked  with  its  consultant  to  revise  the  constructions  plans  in  order  to  remedy  this  issue. To  extend  the  drainage  out  of  the  boundary  limit  line, new  solid  piping  will  be  added  to  NW  191  Street, a  new  French  drain  system  will  be  constructed  to  convey  and  dispose  of  the  stormwater  and  address  flooding  issues.  As  the  project  is  reviewed  for  new  approvals  from  PERA, City  staff  realizes  the  cost  of  these  construction  revisions  will  exceed  the  original  contractor  amount   of  $257, 127.75  by  $56,624.76; however, this  amount  will  not  exceed  the  total  amount  of  the  project  which  was  approved  by  Council. Understanding  the  extra  work  involved  to  complete  the  new  revised  project, Quality  Paving, Inc  approved  contract  (Resolution  #2012 ‐11 ‐1606) was  increased  to  $313,752.51.  Proposed  Action:  That  City  Council  approves  the  attached  resolution.      1515  NW  167  Street, Building  5  Suite  200    Miami  Gardens, Florida  33169   Attachment:  None.
