CORPORATION IN THE AMOUNT OF SIXTEEN THOUSAND, FIVE HUNDRED NINETY -TWO DOLLARS ($16,592.00) FOR SECOND BIDDING PHASE WORK FOR THE MIAMI GARDENS MUNICIPAL COMPLEX; PROVID ING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDIN G FOR AN EFFECTIVE DATE.  Staff  Summary:  Background:  In  July  2010, the  City  Council  adopted  Resolution  No. 2010 ‐138 ‐1319  authorizing  the  City  Manager  to  issue  a  Purchase  Order  to  URS  Corporation  (URS) for  the  design  and  construction  administration  services  for  the  new  Miami  Gardens  City  Hall  Municipal  Complex. URS  has  completed  all  of  the  Construction  ITEM K-8) CONSENT AGENDA RESOLUTION Change Order to URS Corp.   1515  NW  167  Street, Building  5  Suite  200    Miami  Gardens, Florida  33169   Documents  for  the  entire  facility  and  the  Miami  Gardens  Building  Department  approved  the  project  on  April  20, 2012. Phase  I  of  the  construction  project  consists  of  the  Earthwork  Package  which  prepared  the  site  for  the  construction  of  the  Municipal  Complex. In  September  2011, City  Council  passed  Resolution  No. 2011 ‐144 ‐1537  awarding  the  construction  for  the  Earthwork  Package  Guaranteed  Maximum  Price  #1  (GMP  #1) to  Skanska  Building  USA, Inc. Skanska  achieved  Substantial  Completion  on  February  21, 2012. The  Punch  List  has  been  completed  by  Skanska  and  the  Phase  I  Earthwork  project  is  in  the  close ‐out  phase. Skanska  was  to  develop  the  cost  for  the  remaining  construction  (GMP  #2) from  80% Construction  Documents  CDs  which  were  provided  by  URS  on  September  29, 2011. GMP  #2  will  include  the  construction  cost  for  the  City  Hall  Building, Mechanical  Building, Parking  Garage, Site  Work  and  Off ‐Site  Improvements  which  are  Phase  II. GMP  #2  will  also  include  the  construction  cost  for  the  Police  Department  Headquarters  which  is  Phase  III.  Skanska  submitted  the  first  GMP  #2  proposal  on  November  30, 2011. City  staff  met  with  Skanska  throughout  December  and  January  to  reach  an  agreement  for  the  scope, general  conditions  and  construction  cost  for  GMP  #2. In  February, it  was  determined  that  the  sub ‐contractor  quotes  that  Skanska  had  received  for  the  GMP  #2  proposal  were  only  good  for  90  days  and  therefore  no  longer  valid. While  the  negotiations  were  underway  with  Skanska, URS  completed  the  CDs  and  the  100% CDs  were  submitted  to  the  Miami  Gardens  Building  Department  and  Miami  Dade  County  Agencies  for  review  and  approval  on  October  17, 2011.  After  the  initial  review  comments  from  the  County  agencies  and  the  Building  Department  were  incorporated  into  the  drawings  the  100% CDs  were  provided  to  Skanska  in  February  2012  for  the  purpose  of  re ‐bidding  the  project  with  more  complete  documents. Skanska  submitted  a  revised  GMP  #2  proposal  to  the  City  and  URS  on  April  4, 2012. As  Skanska  proceeded  through  the  negotiations  for  GMP  #2  with  the  100% CDs  many  potential  cost  savings  or  “Value  Engineering” items  were  identified. Skanska, URS  and  City  staff  had  several  meetings  throughout  April  and  May  to  select  and  negotiate  the  savings  for  the  appropriate  Value  Engineering  items  to  get  the  construction  cost  to  match  the  project  budget. The  total  savings  for  the  selected  Value  Engineering  items  is  $2,218,438.  City  Council  approved  the  revised  GMP  #2, with  the  selected  Value  Engineering  items  removed, for  a  total  construction  cost  of  $40,749,383  during  the  Council  Meeting  on  May  23, 2012.  The  City  has  negotiated  several  additional  service  change  orders  with  URS  to  increase  the  scope  of  the  work  that  was  required. The  additional  service  items  included: • Relocation  of  all  of  the  existing  trees  on  the  site; • Demolition  for  the  existing  Wachovia  building; • Separate  package  for  the  Phase  I  Earthwork  (GMP  #1);     1515  NW  167  Street, Building  5  Suite  200    Miami  Gardens, Florida  33169   • Separate  package  for  Phase  II  City  Hall, Mechanical  building  and  Garage  (GMP#2); • Separate  package  Phase  III  Police  Department  Headquarters  (GMP  #2);  • Design  for  the  new  NW  185th  Terrace; • New  roadway  lighting  for  N.W. 27  Avenue  and  N.W. 187  Street  and;  • Design  for  all  of  the  open  office  systems  furniture  for  the  City  Hall  and  Police  Department. The  total  for  all  previously  approved  additional  services  is  $324,707.50, which  is  approximately  10% of  the  original  contract  value. Current  Situation: The  original  contract  with  URS  did  not  include  the  second  Bid  Phase  which  was  required  to  reach  an  agreement  with  Skanska. As  part  of  the  this  second  Bid  Phase  URS  was  responsible  for  answering  all  Bid  Inquires  and  review  all  sub ‐contractor  quotes  with  City  staff  to  verify  that  they  were  complete  and  in  compliance  with  the  Construction  Documents. URS  Staff  also  attend  all  of  the  Value  Engineering  (VE) sessions  in  April  and  May  to  evaluate  and  research  the  appropriateness  of  the  proposed  VE  items  by  comparing  the  proposed  items  against  the  quality  of  the  original  specified  items  to  determine  if  they  would  be  acceptable  and  meet  all  L.E.E.D. Platinum  requirements. URS  exceeded  their  original  Bid  Phase  fee  of  $42,000  in  April, but  continued  to  work  with  City  Staff  to  achieve  an  acceptable  GMP  #2  construction  agreement  with  Skanska. URS  submitted  a  proposal  for  the  additional  work  to  the  City  on  June  14, 2012. Staff  has  reviewed  the  fee  and  agrees  that  the  proposal  is  accurate  and  reasonable. The  additional  fee  of  $16,592  is  beyond  the  City  Manager’s  10% approval  threshold  for  change  order  items  for  a  Purchase  Order.  Proposed  Action:  It  is  recommended  that  the  City  Council  approve  the  attached  resolution  authorizing  the  City  Manager  to  issue  a  change  order  for  a  not  to  exceed  fee  of  $16,592  to  URS  Corporation  for  the  Extended  Bidding  Phase  work  for  the  Miami  Gardens  Municipal  Complex. Attachments:  Attachment  – URS  Additional
