Required: (Enter X in box) Yes No RFP/RFQ/Bid #: x Sponsor Name Danny Crew Department:City Manager  Short  Title: A  RESOLUTION  OF  THE  CITY  OF  MIAMI  GARDENS, FLORIDA, AUTHORIZING  THE  CITY  MANAGER  AND  CITY  ATTORNEY  TO  NEGOTIATE  A  VOLUNTARY  TRANSFER  OF  TITLE  OR, FAILING  A  VOLUNTARY  TRANSFER, TO  TAKE  SUCH  STEPS  AS  SHALL  BE  NECESSARY  AND  APPROPRIATE  TO  INSTITUTE  EMINENT  DOMAIN  PROCEEDINGS  PURSUANT  TO  CHAPTERS  73  AND  74, FLORIDA  STATUTES, REG ARDING  THE  CONDEMNATION  OF  THOSE  CERTAIN  PROPERTIES  DESCRIBED  HEREIN; PROVIDING  FOR  FINDINGS  OF  FACT; PROVIDING  FOR  DETERMINATIONS  OF  PUBLIC  PURPOSE  AND  NECESSITY; PROVIDING  FOR  AUTHORIZATIONS; PROVIDING  FOR  THE  ADOPTION  OF  REPRESENTATIONS; PROVIDING  AN  EFFECTIVE  DATE. Staff  Summary:  Now  that  the  City  Hall  is  underway, it  is  necessary  to  secure  title  to  the  proposed  entrance  road  along  the  southern  boundary  of  the  property, more  particularly  located  at  18375/18575  and  18601  Northwest  27  Avenue  as  described  on  Exhibit  A.   Currently, this  property  is  owned  by  the  City  (north  one  half  of  the  ingress ‐egress  way) and  th e  two  property  owners  to  the  south  of  the  City’s  project  (south  one ‐half  of  the  ingress ‐egress  way).   City  staff  has  been  negotiating  with  these  two  property  owners  for  the  voluntary  transfer  of  the  title  of  their  halves  of  the  access ‐way; however, to  date  the  negotiations  have  not  conclude d.  While  the  property  owners  have  agreed  in  principal, their  mortgage  holders  have  been  slow  to  respond  and  approve. ITEM K-6) CONSENT AGENDA RESOLUTION Voluntary Transfer   1515  NW  167  Street, Building  5  Suite  200    Miami  Gardens, Florida  33169   While  City  staff  believes  that  the  City  will  successfully  conclude  the  negotiations, time  is  of  the  essence  and  the  City  needs  to  be  prepared  to  acquire  the  access  way  through  condemnation  if  necessary  so  that  roadway  can  be   completed  by  next  August. This  resolution  directs  staff  to  continue  the  negotiations  but  also  authorizes  staff  to  move  forward  with  condemnation  if  the  negotiations  are  not  successful.   Recommendation:  That  the  City  Council  approves  the  resolution.  Attachment: Exhibit  “A”‐ Legal  Description.
