The following members of the City Council were present: Mayor Oliver Gilbert, Vice Mayor Felicia Robinson and Council members Lisa C. Davis, Lillie Q. Odom, Rodney Harris, David Williams Jr., and Erhabor Ighodaro. Also in attendance were: City Manager Cameron Benson, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. (B) INVOCATION Delivered by Mayor Gilbert (C) PLEDGE OF ALLEGIANCE Recited in unison (D) APPROVAL OF MINUTES D-1) Regular City Council Minutes —January 27, 2016 Motion offered by Councilman Williams, seconded by Councilwoman Davis and Councilman Harris to approve the minutes with the necessary corrections, if any. This motion passed and carried by a unanimous voice vote. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) The following item was added to the official agenda as Item K-3) "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY ATTORNEY TO AMEND THAT CERTAIN AGREEMENT FOR PROFESSIONAL LEGAL SERVICES RELATED TO THE PREDATORY LENDING CASES INVOLVING WELLS FARGO, BANK OF AMERICA AND JP MORGAN; AUTHORIZING THE CITY ATTORNEY TO EXECUTE FUTURE AMENDMENTS TO THAT AGREEMENT RELATING TO COUNSEL WITH THE APPROVAL AND CONSENT OF THE MAYOR; PROVIDING FOR THE ADOPTION OF REPRESENTATION; PROVIDING FOR AN EFFECTIVE DATE" (SPONSORED BY THE CITY ATTORNEY) Items K-2 and K-3 were pulled from the Consent Agenda. Motion offered by Councilwoman Odom, seconded by Councilman Williams to approve the official agenda with the necessary amendments. (F) SPECIAL PRESENTATIONS (5 minutes each) F-1) Councilman David Williams Jr. — Awards for Science Teachers and Coaches Councilman Williams' Elementary School Science and Engineering Fair held December 2015, was a huge success. He credited and recognized the participating schools and the dedicated teachers and science coaches for their exemplary contributions to the students of Miami Gardens. Each was presented with a Certificate of Special Recognition. (G) PUBLIC COMMENTS Former County Commissioner Betty T. Ferguson appeared before the City Council representing Rolling Crest Lakes. She presented a check in the amount of $756.95, to the City of Miami Gardens Swim Team Program. She asked that the City provide Rolling Crest Lakes with a copy of the final invoice for their record. Mr. Dupree, Finance Director for the Rolling Crest Lakes appeared before the City Council to share that this organization is interesting in contributing to more programs being offered at the Betty T. Ferguson Recreation Complex. He encouraged the city to submit the funding proposals for those programs. In addition, a final report from the City of Miami Gardens for the Rolling Crest Lakes sponsorship of the 2015, Teen Summer Job Program was needed in order for this organization to reconcile the books. Mayor Gilbert said the Finance Director will respond to this request. (H) ORDINANCE(S) FOR FIRST READING: None (I) ORDINANCES) FOR SECOND READING/PUBLIC HEARING(S) None (J) RESOLUTION(S)/PUBLIC HEARING(S) None (K) CONSENT AGENDA: RESOLUTION NO. 2016-27-2926 K-1) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, SUPPORTING WOMEN IN THE GARDENS THE YEAR OF THE WOMAN 2016; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (COUNCILWOMAN LISA C. DAVIS) Motion offered by Mayor Gilbert, seconded by Councilwoman Odom to adopt this item. There being no discussion, the motion to adopt passed and carried by a unanimous voice vote. February 10, 2016 City Council Minutes Page 2 CITY COUNCIL MINUTES, FEB. 10, 12016 (L) RESOLUTION(S) RESOLUTION NO. 2016-28-2927 K-2) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AWARDING A BID TO RECREATIONAL DESIGN & CONSTRUCTION, INC., FOR BUCCANEER PARK IMPROVEMENTS IN RESPONSE TO RFP 15-16-014; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Councilman Ighodaro opined that it is worth knowing that staff had followed through in terms of the city's program. He shared that he had communicated with the City Manager several months prior about putting together a program to streamline the bidding process for the GOB initiative. This proposal provides job opportunities for city residents. He conveyed the importance of monitoring the implementation of this program. Manager Benson expounded on this program and shared that it is designed to assist local businesses and residents to participate in the City's General Obligation Bond Process, as well as other types of bids going forward. He said on March I St the city will host an event where businesses and residents can come out to register to be a part of this program. Local hires will have applicable identification for monitoring purposes. Motion offered by Councilman Ighodaro, seconded by Vice Mayor Robinson and Councilman'Williams to adopt this item. There being no further discussion, the motion to adopt passed and carried by a unanimous voice vote of the Council. RESOLUTION NO. 2016-29-2928 K-3) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY ATTORNEY TO AMEND THAT CERTAIN AGREEMENT FOR PROFESSIONAL LEGAL SERVICES RELATED TO THE PREDATORY LENDING CASES INVOLVING WELLS FARGO, BANK OF AMERICA AND JP MORGAN; AUTHORIZING THE CITY ATTORNEY TO EXECUTE FUTURE AMENDMENTS TO THAT AGREEMENT RELATING TO COUNSEL WITH THE APPROVAL AND CONSENT OF THE MAYOR; PROVIDING FOR THE ADOPTION OF REPRESENTATION; PROVIDING FOR AN EFFECTIVE DATE" (SPONSORED BY THE CITY ATTORNEY) Councilman Williams referenced the language "with the approval and consent of the February 10, 2016 City Council Minutes Page 3 CITY COUNCIL MINUTES, FEB. 10, 12016 Mayor", and asked whether this issue would come back to Council for approval. Attorney Dickens in response to Councilman Williams' inquiry said there is no need for this item to come back to the Council. She referenced a situation where she had a scheduled mediation and the inability to get substitute Counsel at a moment's notice. She said she did not want to have a similar situation happen in the future, and wanted to make sure someone from the dais was involved. Motion offered by Councilman Williams, seconded by Councilwomen Davis and Odom to adopt this item. There being no further discussion, the motion to adopt passed and carried by a unanimous vote of the members present. QUASI-JUDICIAL ZONING HEARINGS: (M) ORDINANCES ON FOR FIRST READING(S): None (N) ORDINANCES ON FOR SECOND READING/PUBLIC HEARING(S) None (0) RESOLUTION(S)/PUBLIC HEARING(S) None (P) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK P-1) MGPD Monthly Report —December 2015 Attorney Dickens asked everyone to join her in saying farewell to Attorney Monica Barnes. She thanked Attorney Barnes for all of her hard work over these past seven (7) years. (Q) REPORTS OF MAYOR AND COUNCIL MEMBERS Councilman Williams shared that he'd attended a community meeting this past weekend. One of the issues that came up was that the city has a four (4) day rule relating to agenda items. He asked whether the City had a four (4) day rule. Attorney Dickens in response to Councilman Williams' inquiry said there is no four (4) day rule. Councilwoman Davis wished everyone a Happy Valentine's day. Councilman Harris reminded everyone of the Food Truck Invasion, Friday, February 19th from 5:30-9:00 PM, at Rolling Oaks Park. Councilman Ighodaro announced that the Black History Program is scheduled for Saturday, February 27, 2016, at the Betty T. Ferguson Recreation Complex. This year's event has a Business Expo component, which will take place during the morning. The reception and fashion show, as well as entertainment will take place during the evening hours. Vice Mayor Robinson announced that Florida Memorial University's Homecoming Parade will take place this weekend, starting at 8:00 AM, at NW 183rd Street, traveling south along NW 42nd Avenue. She further announced that she is co -sponsoring a Black History event with County Commissioner Barbara Jordan, at Betty T. Ferguson Recreation Complex. She also apologized to anyone that came out on last Saturday for the Red Dress Red Wine reception. That event was cancelled due to incumbent weather, and rescheduled to February 26th, at City Hall. She shared the Red Dress Red Wine event was the kick-off to the City's partnership with the American Heart Association. Mayor Gilbert thanked staff for putting together the Black History event with Lakes Stevens Middle School participants. The event highlighted the many African Americans who contributed greatly to this country. It also provided an historical educational forum on Black History. He further acknowledged Barbara Hawkins Elementary school students for naming the Mascot "Freedom".
