REGULAR CITY COUNCIL MINUTES
SEPTEMBER 13, 2016
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Tuesday, September 13, 2016, beginning at 7:00 PM, in the City Council Chambers, 18605 NW
27th Avenue, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Felicia Robinson and Council members: Lisa C. Davis, Rodney Harris, David Williams
Jr., and Erhabor Ighodaro. Councilwoman Lillie Q. Odom arrived at 7:04 PM.
Also in attendance were: City Manager Cameron D. Benson, City Attorney Sonja K.
Dickens, and City Clerk Ronetta Taylor.

Motion offered by Vice Mayor Robinson, seconded by Councilwoman Davis to approve
the minutes, with necessary corrections, if any. There being no discussion the motion to approve
passed and carried by a unanimous voice vote of the City Council members present.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Councilman Ighodaro withdrew Item L-1 from the official agenda.
Manager Benson withdrew Item H-2, from the Official Agenda.
Motion offered by Councilman Ighodaro, seconded by Vice Mayor Robinson to approve
the official agenda with the necessary changes. There being no discussion the motion to approve
passed and carried by a unanimous voice vote of the City Council members present.
(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) City Manager — FDOT — Golden Glades Multimodal Transportation Facility
Carlos Castro, a representative from the Florida Department of Transportation appeared
before the City Council to announce an upcoming public information meeting on September 22,

2016, at the Evangel Church International, 590 NW 159 Street, Miami, FL 33169. The meeting
will be conducted as an open house from 6:00 PM to 8:00 PM
(G) PUBLIC COMMENTS
Brenda Harper, President of the Riverview Neighborhood Crime Watch Program, 3266
NW 203rd Terrace, Miami Gardens, Florida, appeared before the City Council to congratulate the
council members on their recent re-election. She further offered words of encouragement to
Councilman Williams. She also thanked the Council for its generous donation last year, and
thanked Councilwomen Davis and Odom for their support during this group's third anniversary.
She asked for contributions to assist with this year's anniversary.
Mr. Thony, 1282 NW 172nd Terrace, Miami Gardens, Florida, appeared before the City
Council to express concern about not being grandfathered in for a boat he has in his yard. He
said he had asked for an exception and was told to come to the Council meeting to get that.
Mayor Gilbert informed Mr. Thony that appearing before the City Council at a Council
meeting is not correct. He said Mr. Thony should be speaking with the city manager and his
staff. He explained the codes that are being enforced are not new codes. He informed Mr.
Thony that staff is waiting in the back of the room to speak with him about the specifics of his
circumstances.
Levell Jackson, 1241 NW 174th Street, Miami Gardens, Florida, appeared before the City
Council to express concern with drug rehabilitation centers being placed in his neighborhood
(Scott Lake Manor). He further expressed concern that the residents were not made aware that
facilities were being located within their communities.
Mayor Gilbert explained if a particular use permit is not required or a zoning change is
not required the City Council would not necessarily know about it. That means the particular
"use" falls within a certain category therefore it would not come before the Council for a public
hearing. He asked Ms. Bispot and Mr. Waters to assist Mr. Jackson with this concern, as well
as to find out what the area is zoned for.
W. Ervan Miller, 1370 NW 207th Street, Miami Gardens, Florida, appeared before the
City Council to express concern with the lack of the City's logo on Councilwoman Lisa C.
Davis' Wine and Food Experience flyer.
Marc Napolitano, Sunshine State Industrial Park Association Member, 1521 NW 165th
Street, Miami Gardens, Florida, appeared before the City Council in support of Item 0-1.
(H) ORDINANCE(S) FOR FIRST READING:
H-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA AUTHORIZING THE
BORROWING OF SIX MILLION SEVEN HUNDRED FIFTY

Manager Benson said this item is related to the issues associated with City Hall and the
Police Building. Staff was able to work through some of those issues. The dollar amount was
also negotiated down from 8 Million to 6.75 Million, which is before the Council tonight.
There is also pending litigation regarding issues; today staff was able to reach a verbal
agreement, moving forward to settle that case. That settlement agreement will be brought
before the Council at the September 28th City Council meeting. He stated the borrowing is to
complete the payment for City Hall and the Police Building.

Councilman David Williams Jr., declared a conflict and left the meeting while this item
was being discussed.
Mayor Gilbert opened the floor for this public hearing.
Sandra McDowell, 18240 NW 41s' Place, Miami Gardens, Florida, appeared before the
Council to comment on Carrfour Supporting Housing, Inc. She shared this entity is in the City
of Miami Gardens however it owes association fees, while at the same time requesting money
from the City.
Edythe Higgs, representing Sunshine for All with a residential address at 16430 NW 24th
Avenue, Miami Gardens, Florida, appeared before the City Council to solicit the Council's
approval of this funding.
Jennifer Johnson, 18735 NW 37th Avenue, Miami Gardens, Florida, appeared before the
City Council in support of Sunshine For All's continued funding.
Julio Rodriguez, Assistant Director for Sunshine For All, Inc., appeared before the City
Council to solicit continued funding for his organization. He said there is currently a waiting list

with over forty (40) people. He asked for funding in the amount of $70,000.00.
Mayor Gilbert inquired about Sunshine For All's administrative cost and recounted that
last year it was unreasonably high. At that time it was suggested that Sunshine For All reduce
their administrative cost.
Mr. Rodriguez said there is only $8,000.00, for salaries.
Mayor Gilbert opined the administrative cost for everyone apply for CDBG dollars
should be no more than twenty (20%) percent. This funding is supposed to go to people who
cannot help themselves. He asked staff to ensure an administrative cost cap is a part of the
application process moving forward.
Rachel Taalibdeen appeared before the City Council representing North Dade Youth and
Family Coalition, 769 NW 157t` Street, Miami Gardens, Florida. She thanked the Council for its
continued funding support. She shared many of the services provided by her organization also
included senior services. She also shared there are many organizations within the City of Miami
Gardens that provides meals for seniors.
There being no other interested parties to speak on this item, the public hearing closed.
Motion offered by Councilman Harris, seconded by Councilwoman Odom to adopt this
item.
Councilman Ighodaro referenced Sunshine For All, Inc., program, which provides meals
to the elderly population in Miami Gardens. He shared his understanding that this program has
been funded for the past eight (8) years. He said he is in agreement with staff taking whatever
steps necessary to ensure administrative cost are kept down. He said he was looking at the forty
(40) or more elderly residents on the waiting list, and opined that speaks to the needs of our
residents for food. He said he was not comfortable with talking food out of the mouth of
somebody that needs it. He shared that he would be speaking with the City Manager about
contributing the $2,000.00 from his Council account to close that deficit.
Mayor Gilbert applauded Councilman Ighodaro for contributing from his Council
account for this purpose.
There being no further discussion the motion to adopt passed and carried by a unanimous
vote of the members present. Councilman Williams was out of the chambers during this
discussion.

Mayor Gilbert shared that the Council just passed zoning on two developments that are
owned by private companies, which the City has no control over. There were no comments on
those properties. The only comments were on property the City owns and has control over.

Mayor Gilbert opened the floor for the public hearing.
Mary A. Williams, 18761 NW 390h Court, Miami Gardens, Florida, appeared before the
City Council representing the senior groups in Miami Gardens. She recounted the intent and
purpose for the purchase and development of the above referenced property. She opined once
the property is rezoned it can become anything including low-income housing. She said the
senior housing development would reduce the size of the Senior Family Center, as well as
endanger the lives of senior citizens. She asked the Council members to vote no on the rezoning
of this property.
Linda H. Holloway, 748 NW 204th Street, Miami Gardens, Florida, appeared before the
City Council representing the seniors. She said the seniors were here tonight because they are
concerned about the rezoning of the property. Currently the seniors share space at the Betty T
Ferguson Complex, which is at times not too accommodating. In 2009, this property was
purchased to construct a Recreation facility to be utilized for seniors only. She asked the
Council to continue with the plan started in 2009.
Tanya James, 18721 NW l lth Place, Miami Gardens, Florida, appeared before the City
Council representing the Elderly Affairs Advisory Committee. She clarified what the Elderly
Advisory Committee's recommendation was back in 2014. She said at that time the Committee
was working with the Alliance for Aging with a goal and initiative to create programs for older
adults as well as sustainable housing. She said that she stood in solidary on behalf of the Elderly
Advisory Committee, with the seniors. She stated the Elderly Affairs Advisory Committee is not
in support of senior housing on that property.
There being no other interested parties to speak on this item, the public hearing closed.
Motion offered by Vice Mayor Robinson, seconded by Councilman Williams to adopt
this item on first reading.
Mayor Gilbert said that Ms. Flora Johnson, a member of the Elderly Affairs Advisory
Committee was in attendance at a meeting at City Hall when she asked for senior housing. He
shared that when elected officials run for office and take the oath they give their word that they
are going to do what's best for the entire city. He shared as it relates to this particular property
he was the one who suggested the funding mechanism so that the City could actually build the

senior center. Therefore it is safe to say that he wants the senior center built. The property is
huge and can be divided to do housing on one side. He emphasized the City owns this property
therefore if the zoning is changed the City is certain whatever the intent is it will not be deviated
from. The Council gets to say this rezoning is just for seniors. This is one of the unique
properties within this city that the Council can control. He said he was in favor of subdividing it
not because he did not care about the residents' opinion because he does. He said the Council
can guarantee what the residents want in that development and accommodate seniors that are
transitioning out of their homes.
Mayor Gilbert shared that he receives calls all the time about the waiting list at St.
Monica. He said there has to be a solution for those seniors that are transitioning out of their
homes. If there is no senior housing in Miami Gardens to accommodate that transition, those
seniors will have to transition out of the City. He said he would not do anything to jeopardize
the senior center development. He placed emphasis on the importance of building senior
housing now as opposed to later in the future. He said this is a chance to build that senior
housing at no cost to the City.
Councilman Harris asked what would happen to the senior center if this item was not
adopted.
Manager Benson in response to Councilman Harris' inquiry said this rezoning would not
affect the senior center development.
Vice Mayor Robinson said she is aware of the request for senior housing. She said the
Council had many options with this property however it elected to put the seniors there.
Mayor Gilbert said if the Council approves this rezoning and something comes forward
that the Council doesn't like; the Council gets to say no. He emphasized the city owns this
property. He said if Ms. Williams agrees to set on the committee with staff and the developers
to review the plans for both the housing and the senior center he is comfortable with that. He
reiterated that he is comfortable with that because he is comfortable with what the Council's
capacity is.
Vice Mayor Robinson recalled when this item was first brought before the Council for
consideration due to funding requirements she'd asked whether this entity has been approved for
the funding. At that time it was understood that this item was to come back before the Council
for final consideration.
Mayor Gilbert in response to Vice Mayor Robinson shared the funding cycle has not
started.
Councilwoman Odom pointed out that the wording used here is "multi -family housing."
She asked what is to prevent the group from coming in the future with another type of
development.
Mayor Gilbert reiterated this is unique because this is actually the City's property. He

said the City is asking to change the zoning on a property it actually owns. Therefore the City
would have to vote to put something on this property.
Councilwoman Odom said the zoning change is for "residential multi -family dwelling",
and asked what is to prevent someone from coming in and placing multi -family housing.
Mayor Gilbert in response to Councilwoman Odom's inquiry said the Council would
prevent it because this is City owned property.
Councilwoman Davis asked how far away distance wise is the housing going to be from
the senior center.
Manager Benson said he could not give a footage distance however the proposed senior
housing would be more northwest from the senior center. Also keep in mind the existing farm
house will remain, which will act as a barrier between the senior center and the senior housing
development. He said there are many ways to design the facilities so that there is no interaction
at all.
Councilman Williams asked if there was any way the seniors could be included in the
process of developing this.
Mayor Gilbert in response to Councilman Williams' inquiry said if Ms. Williams, who is
the spokesperson for the senior group wants to provide her services, she can be included.
Councilwoman Davis said this item is very important to her because it is in her
residential area and whatever the seniors want that is what she is going to go with.
Councilman Williams suggested deferring this item until after a meeting has been held
with the seniors.
Mayor Gilbert said he did not have a problem with deferring this item and scheduling a
meeting. He reiterated that at some point we are going to have to have senior housing within the
city.
Motion offered by Councilman Williams, seconded by Councilwomen Davis and Odom
to defer this item until the October 12th City Council meeting.
Vice Mayor Robinson stated that she was surprised and did not understand the seniors
having a problem with the Council providing housing for them. She shared that initially she was
not for senior housing on this property. However taking other things into consideration she came
around. She welcomed a meeting between the seniors and staff.
There being further discussion the motion to defer passed and carried by a unanimous
vote of the Council members.

Councilwoman Odom invited everyone out to the AIDS/HIV Senior event, September
22, 2016, at the Betty T. Ferguson Center.
Councilman Harris invited everyone out to the Food Truck Invasion, third Friday of each
month.

Vice Mayor Robinson invited everyone out to the Meet Me on Monday meeting. The
Sickle Cell Foundation was in attendance at yesterday's meeting and provided very invaluable
and informative information.
Councilwoman Davis announced that Mrs. Rita Pierre, Chair of the Norland Crime
Watch lost her daughter. She asked that everyone keep the Pierre family in their prayers.
Mayor Gilbert thanked everybody for re-electing him. He said he is always talking about
building a community where you can do business; where people can live, work, play. The
Council is going to continue to do that. He emphasized the importance of economic
development. He further expressed the importance of senior housing for the seniors who are
transitioning from their home.
