HomeMy WebLinkAbout2019-147-3276 City of Miami Gardens and RG Towers, LLC RESOLUTION NO. 2019-147-3276 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE AN UNDERGROUND EASEMENT IN FAVOR OF FLORIDA POWER & LIGHT COMPANY IN SUBSTANTIAL FORM AS THAT EASEMENT ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, at the January 24, 2018, City Council meeting per Resolution Number 2018-18-3331, an Agreement was approved between the City of Miami Gardens and RG Towers, LLC for the purpose of licensing certain portions of real property at Rolling Oaks Park and Betty T. Ferguson Recreation Center, and WHEREAS, the licenses provide for the right for RG Towers, LLC to construct, maintain, and operate a wireless telecommunications facility on a specified parcel at each of the parks, and WHEREAS, along with approval of the parcels that will receive the telecommunications facilities, a utility and access easement was also approved by the City to each of the parcels, and WHEREAS, in order to provide electrical service to each telecommunications facility, Florida Power &Light Company (FP&L) will place underground electric lines to each parcel, however, Florida Power and Light requires their own separate easement for their specific infrastructure, and WHEREAS, at the February 13, 2019, City Council meeting per Resolution Number 2019-070-3699, the City granted separate easements to FP&L for the purpose of placing underground electric lines to each parcel, and WHEREAS, during final engineering and design, it was determined that at Rolling Oaks Park, FP&L requires an alignment that differs from that originally dedicated, attached hereto as Exhibit "A", is the revised alignment needed to place underground power lines in order to energize the cell tower, and WHEREAS, Staff recommends that the City Council approve the easement in favor of Florida Power & Light Company to provide for electric service to the telecommunications facilities sites, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby authorizes the City Manager to execute an underground easement in favor of Florida Power & Light Company in substantial form as that easement, attached hereto as Exhibit "A". Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
