HomeMy WebLinkAbout10.23.2013 CITY COUNCIL MINUTES-OCTOBER 23, 2013 CITY OF MIAMI GARDENS REGULAR CITY COUNCIL MINUTES OCTOBER 23, 2013 (A) CALL TO ORDER/ROLL CALL The City Council for the City of Miami Gardens, Florida, met in regular session, Wednesday, October 23, 2013, beginning at 7:00 p.m., in the City Council Chambers, 1515 NW 167'hStreet, Building 5, Suite 200, Miami Gardens, Florida. The following members of the City Council were present: Mayor Oliver Gilbert, Vice Mayor Lisa C. Davis and Council members: Lillie Q. Odom, Rodney Harris, Felicia Robinson, David Williams Jr., and Erhabor Ighodaro. Also in attendance were: Interim City Manager Cameron Benson, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. (B) INVOCATION Delivered by Dr. Lester Brown (C) PLEDGE OF ALLEGIANCE Recited in unison (D) APPROVAL OF MINUTES Regular City Council Minutes—October 9, 2013 Motion offered by Councilman Williams, seconded by Vice Mayor Davis to approve the minutes, with necessary corrections, if any. This motion passed and carried by a unanimous voice vote. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) Item K-03 was pulled from the Consent Agenda by Councilman Harris. Item K-08 was pulled from the Consent Agenda by Vice Mayor Davis The following item was added as Item K-09 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, EXPRESSING SUPPORT FOR THE NOVEMBER 8, 2013, MIAMI-DADE COUNTY MILITARY AFFAIRS BOARD "GOLDEN VETERANS PARADE, 50TH ANNIVERSARY COMMEMORATION", COMMEMORATING THE 50' ANNIVERSARY OF THE VIETNAM WAR; PROVIDING INSTRUCTIONS TO THE CITY MANAGER; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE." Mayor Gilbert asked that Item 0-1)be moved forward to be heard as Item F-0. Motion offered by Vice Mayor Davis, seconded by Councilman Williams to approve the Regular City Council Minutes October 23, 2013 Page 1 CITY COUNCIL MINUTES-OCTOBER 23, 2013 official agenda, with the necessary additions/deletions/changes. This motion passed and carried by a unanimous voice vote. (F) SPECIAL PRESENTATIONS (5 minutes each) Cyril Saiphoo, Zoning Administrator appeared before the City Council to provide information regarding the process used for this Quasi-Judicial procedure. Clerk Taylor swore all parties participating in this Quasi-Judicial Proceeding. F-0) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE APPLICATION SUBMITTED BY FLORIDA AUTO REAL ESTATE HOLDINGS, LLC, FOR THE PROPERTY LOCATED AT 19300, 19390 N.W. 2ND AVENUE, MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO, FOR A SPECIAL EXCEPTION TO ALLOW USED VEHICLES SALES AS A PERMITTED USE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE INTERIM CITY MANAGER) The applicant requested the item be deferred to the next City Council Meeting, scheduled for November 13,2013. Motion offered by Councilman Ighodaro, seconded by Councilman Williams to defer this item until the November 13, 2013 City Council meeting. There being no discussion, the motion to defer passed and carried by unanimous voice of the Council. F-1) Denese Williams, Grants/Contracts Administrator—Ms. Lauren Oater, Barry University Denese Williams, Grant Administrator for the City of Miami Gardens along with Lauren Oater of Barry University appeared before the City Council to provide information about the nursing program, which would be assisting the residents of Miami Gardens. F-2) Councilwoman Felicia Robinson Councilwoman Robinson presented a plaque to Mr. Andre Stafford, a Security Guard assigned to Miami Carol City High School; acknowledging his outstanding contributions to the community, the Miami Gardens Police Department, and Carol City High School F-3) Mathew Boyd,Police Chief—Officer of the Month Deputy Chief Miller bestowed upon Officer, the distinguished honor of Officer of the Month for October 2013. (G) PUBLIC COMMENTS None (H) ORDINANCE(S) FOR FIRST READING: H-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING SECTION 2-51- "AGENDA", SECTION 2-60-"PUBLIC PARTICIPATION" OF THE CITY'S CODES OF ORDINANCES TO IMPLEMENT CHANGES MADE IN THE LAST LEGISLATIVE SESSION; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. (SPONSORED BY THE CITY ATTORNEY) Attorney Dickens explained this is a house keeping item relating to amendments made during the 2013 Legislative Session regarding Public Participation. Motion offered by Vice Mayor Davis, seconded by Councilwoman Odom to adopt this item. There being no discussion,the motion to adopt passed and carried by a 7-0 vote. (SPONSORED BY THE CITY CLERK) Clerk Taylor explained this is a house keeping item, relating to the amendments adopted during the State Legislative Session in 2013, which increased the amount of contribution an individual can make from $500.00 to $1000.00. Mayor Gilbert opened the floor for this public hearing. After there were no interested parties to speak on this item,the public hearing closed. Motion offered by Vice Mayor Davis, seconded by Councilwoman Odom to adopt this item. There being no discussion, the motion to adopt passed and carried by a 7-0 vote. (L) RESOLUTION(S): RESSOLUTION NO. 2013-240-1936 K-3) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, HOSTING THE 3RD ANNUAL CITY OF MIAMI GARDENS SCIENCE AND ENGINEERING FAIR FOR ELEMENTARY-AGED STUDENTS; AUTHORIZING THE CITY MANAGER TO EXPEND THE SUM OF TEN THOUSAND DOLLARS ($10,000.00), FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY COUNCILMAN DAVID WILLIAMS JR.) Councilman Harris asked for clarification on the item, as it related the expenditure amount. Mayor Gilbert explained that the $70,000.00 budgeted for the Council will be allocated to each Council to assist with their individual projects, up to $10,000. He cautioned everyone spending at once because the City receives its revenues in increments. RESOLUTIO NO. 2013-241-1937 K-8) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE FINAL PLAT FOR "STADIUM PLAZA" SUBMITTED BY RMS PROPERTIES IV, LLC, FOR THE PROPERTY GENERALLY LOCATED AT THE SE CORNER OF NW 199TH STREET AND NW 27 AVENUE, MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE INTERIM CITY MANAGER) Vice Mayor Davis stated she had pulled this item for further clarification. Cyril Saiphoo, Zoning Administrator appeared before the Council in response to Vice Mayor Davis' question. He stated a tentative plat was approved by the City of Miami Gardens and Miami-Dade County for the vacant parcel located on the SE Corner of NW 199th Street and NW 27th Avenue next to the Sonic Restaurant, for a retail/commercial development. The Final Plat approval will authorize the City to issue a final Certificate of Occupancy for the proposed retail/commercial development on the property. Vice Mayor Davis invited everyone to attend the Diabetes Event scheduled for Sunday, November 17, 2013. Mayor Gilbert shared some of the highlights from his visit to Israel and the Holy Land.
