The following members of the City Council were present: Mayor Shirley Gibson, Vice Mayor Oliver G. Gilbert III, and Council members: Aaron Campbell Jr., Lisa C. Davis, Andre Williams, Felicia Robinson, and David Williams Jr. (B) INVOCATION Delivered by Councilman David Williams Jr. (C) PLEDGE OF ALLEGIANCE Recited in unison. (D) APPROVAL OF MINUTES Regular City Council Meeting—May 9,2012 Motion offered by Councilman David Williams Jr., seconded by Councilman Campbell to approve the minutes with necessary corrections, if any. This motion passed and carried by a unanimous voice vote. Regular City Council Meeting—May 23,2012 Motion offered by Councilman David Williams Jr., seconded by Councilman Campbell to approve the minutes with necessary corrections, if any. This motion passed and carried by a unanimous voice vote. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) The following item was added to the official agenda: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE THAT CERTAIN MEMORANDUM OF UNDERSTANDING WITH FLORIDA MEMORIAL UNIVERSITY, THE JESSIE TRICE COMMUNITY HEALTH CENTER, THE MIAMI-DADE HEALTH DEPARTMENT, AND THE NORTH DADE YOUTH AND FAMILY COALITION TO REDUCE HEALTH DISPARITIES AND PROMOTE HEALTHY LIFESTYLES IN MIAMI GARDENS, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. Regular City Council Agenda June 13, 2012 Page 1 Motion offered by Vice Mayor Gilbert, seconded by Councilwoman Davis to approve the official agenda, with the necessary additions/deletions. This motion passed and carried by a unanimous voice vote. (F) SPECIAL PRESENTATIONS (5 minutes each) F 1) Couneilfaaa David Williams jr-. Crestview Elementary Seh F-2) Mr. Casbaro, KAPOW (Kids and the Power of Work Mentoring Program) Mr. Casbaro appeared before the City Council to thank the City of Miami Gardens for participating in the KAPOW Program. He further acknowledged several department and division directors for their participation. F-3) Caribbean Affairs Advisory Committee—Caribbean Heritage Month Karlyn Hylton, Co-Chair of the Caribbean Affairs Advisory Committee appeared before the City Council to highlight Caribbean Heritage Month. She further spotlighted several local businesses for their outstanding contributions to the Caribbean Affairs Advisory Committee. Mayor Gibson was also acknowledged for her support. (G) PUBLIC COMMENTS Sandra McDowell, 18240 NW 41St Place, Miami Gardens, Florida, appeared before the City Council and asked for a status report from the last City Council meeting with regard to the closing of old open Miami-Dade County Homeowners' Building Permits issued prior to the incorporation of the City of Miami Gardens. Manager Crew explained this matter has to be thoroughly researched therefore an answer would not be forthcoming tonight. He expressed concern with having the city write-off the $75.00 Inspection fee, which is required when closing out a open permit. He said there are thousands of open Miami-Dade County Homeowners' permits in Miami Gardens. Shellie Ransom-Jackson, Building Official/Interim Building Department Director appeared before the City Council to further expound on this matter. (H) ORDINANCE(S) FOR FIRST READING: H-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING SECTION 2-765 OF THE CITY'S CODE OF ORDINANCES ENTITLED "CONE OF SILENCE"; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Pamela Thompson, Procurement Manager for the City of Miami Gardens appeared before the City Council and explained the City's Code provides for exemptions to the Cone of Silence. One of those is the competitive process for the award of Community Development Block Grant, Regular City Council Agenda June 13, 2012 Page 2 Home and Ship funds administered by the Community Development Department. This amendment provides for the removal of this process from the Cone of Silence. Motion offered by Vice Mayor Gilbert, seconded by Councilwoman Davis to adopt this item on first reading. Williams Jr: Yes Mayor Shirley Gibson: Yes H-2) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING ARTICLE IX, DIVISION 1, SECTION 2-700 "DEFINITIONS" AND DIVISION 3, SECTION 2-752 "PURCHASES IN EXCESS OF $50,000" OF THE CITY'S CODE OF ORDINANCES; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Manager Crew explained this is a housekeeping item. In the last Legislative Session, the Florida Legislation made certain revisions to Chapter 119 and Chapter 286, of the Florida Statutes, relating to public records and meetings. One of those revisions related to bid opening procedures. That change necessitated a change to the City's bid opening procedures as outlined in Section 2-752 of the City's Purchasing Code. Motion offered by Vice Mayor Gilbert, seconded by Councilman Andre Williams to adopt this item on first reading. "SYNTHETIC DRUGS"; BY ADDING SECTION 14-346 "PROHIBITING THE SALE AND DISPLAY OF SYNTHETIC CANNABINOIDS"; PROVIDING FOR DEFINITIONS; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. (SPONSORED BY VICE MAYOR OLIVER G. GILBERT) Vice Mayor Gilbert shared his rationale for sponsoring this item. He also provided an attachment to the item, which is a"Written Statement of Joseph T. Rannazzisi, Deputy Assistant Administrator Office of Diversion Control Drug Enforcement Administration, United States Department of Justice entitled"The Dangers of Synthetic Cannabinoids and stimulants. Motion offered by Vice Mayor Gilbert, seconded by Councilman Campbell and Councilwoman Davis to adopt this item on first reading. Councilman Andre Williams asked whether Vice Mayor Gilbert would consider an amendment to the ordinance to include bath salts. Vice Mayor Gilbert, in response to Councilman Andre Williams' inquiry stated not objection. Motion offered by Councilman Andre Williams, seconded by Councilman David Williams Jr.,to amend the ordinance to include bath salts. There being no further discussion on the amendment, the motion to adopt the amendment passed and carried by a unanimous voice vote. (SPONSORED BY COUNCILMAN DAVID WILLIAMS JR.) Councilman David Williams Jr., said this is a grant being initiated by the National Institute of Health and Minority Disparity. This resolution would give the City Manager the authority to partner with the other entities mentioned in the resolution. He said this MOU is being approved subject to the approval of the President and Provost from Florida Memorial University. He further thanked staff for getting this together is such a short time. The problem is the grant application is due June 27, 2012, which is also the date of our next city council meeting. Motion offered by Councilman David Williams Jr., seconded by Vice Mayor Gilbert to adopt this item. This motion passed and carried by a unanimous voice vote. (M) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK No reports. (N) REPORTS OF MAYOR AND COUNCIL MEMBERS Vice Mayor Gibson wished all fathers a Happy Father's Day. Councilwoman Davis announced she is co-hosting a Candidates' Form with New Fountain of Life Church, June 25, 2012 from 6:30 p.m. This form specifically designed for the city of Miami Gardens' Mayoral candidates, Residential Area Seat 1 and Seat 3 candidates, as well as State Representatives, County Judges and State Attorney. She invited everyone to come out for this event. Mayor Gibson announced that New Way Fellowship and Worship Center will be hosting an event, Sunday, June 24`h honoring her for her tenure as Mayor for the City of Miami Gardens.
