A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, DETERMINING THAT THE LAND
DESCRIBED IN EXHIBIT "A" HERETO IS NOT NEEDED FOR A
PUBLIC PURPOSE; DETERMINING THAT THE DISPOSAL OF
THE LAND IS IN THE BEST INTEREST OF THE CITY,-
AUTHORIZING
ITY;AUTHORIZING THE MAYOR, CITY MANAGER CITY
ATTORNEY AND CITY CLERK TO TAKE ALL STEPS
NECESSARY TO CONVEY THE LANDS DESCRIBED IN
EXHIBIT "'A' TO BH MIAMI GARDENS TOWN CENTER, LLC;
RELEASING ANY RESERVED INTEREST IN SAID LANDS
UPON CONVEYANCE; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami Gardens is the owner of the parcel(s) of land
located on the northeast corner of N.W. 191st Street and NW 27th Avenue with Folio
No. 34-2103-001-0715, containing approximately 2.483 acres of unimproved land; and
Folio No. 34-2103-001-0710 containing approximately 33.185 acres of unimproved land
on the north and south sides of NW 191st Street located east of NW 27th Avenue
("Property"), and
WHEREAS, on October 24, 2018, the City Council authorized the transfer of the
Property to BH Miami Gardens Town Center, LLC in accordance with Ordinance No.
2018-19-400, and
WHEREAS, as a part of the title Commitment for the Property, the Title
Company is requesting that that the City confirm that the Property is unnecessary for a
public purpose; determine that the disposal of the land is in the best interest of the City;
authorize the Mayor, City Manager, City Attorney and City Clerk to take all steps
necessary to convey the Property BH Miami Gardens Town Center, LLC and
specifically authorizes the City Manager or his designees with requisite knowledge to
make such affidavits as shall be appropriate to the circumstances; and release any
reserved interest in said Property upon conveyance, and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby determines that the Property described in Exhibit "A" attached hereto is not
needed for a public purpose; determines that the disposal of the land is in the best
interest of the City; authorizes the Mayor, City Manager, City Attorney and City Clerk to
take all steps necessary to convey the Property BH Miami Gardens Town Center, LLC
and specifically authorizes the City Manager or his designees with requisite knowledge
to make such affidavits as shall be appropriate to the circumstances; and releases any
reserved interest in said Property upon conveyance of the Property.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.
